My property got messed up from grading and other stuff because of the work they're doing for my neighbor
My property got messed up from grading and other stuff because of the work they're doing for my neighbor. I've been trying to talk to someone about it, but nobody wants to talk to me or help fix the damage. They're building a pool in my neighbor's backyard, but they keep using my property like it's their own personal work zone. They've blocked my driveway multiple times with their vehicles, so I can't even get in or out. One time, an employee just ignored my wife when she was trying to pick up our daughter from school because his truck and trailer were in the way. The problem now is that they messed up my neighbor's side yard and wrecked mine in the process. They drove their big vehicle all over my front and back yards, leaving deep tracks in some spots. Now I've got sand and gravel where there used to be grass. They didn't even bother to put up erosion control before they started working, even though they're supposed to keep debris from going onto other properties and the protected land behind us. They clearly don't care about anything except themselves.
Our pool was completed in Oct
Our pool was completed in Oct. 2020 and the Pentair system hasn't worked right for even one full day. No one from Gulfstream will help me. Besides the terrible experiences we had during the pool construction with Gulfstream (like Ted, the project manager, verbally attacking me on the phone and the paver issues that took over a month to fix, not to mention our spa not working properly after it was done), this complaint is specifically about how the Pentair system with the app hasn't worked at all since our pool was finished in Oct. 2020. I've made countless calls to Gulfstream, but they haven't come out once to fix it. After about a month of calling and complaining, they said they would come in late November to fix it, but I never heard back from them after that. They also suggested I contact Hawkins Service Company, who handles Pentair warranty issues. (I have another complaint against Hawkins for not fixing the problem.) However, since Gulfstream never showed up (even though I waited a whole month for them), and Hawkins didn't fix it either, Hawkins told me to ask Gulfstream for an alternative solution: a handheld remote to control the pool instead of the app. I called Gulfstream again for this, but it still hasn't been resolved. So, it's been 3 months since we got our pool, and there's been no fix or solution. First, we paid extra to have the app and system installed, but they haven't made any effort to refund us for not being able to use it. Second, when I asked for the handheld remote, they said they would take care of it right away. But, just like always, Gulfstream hasn't contacted me since to give me the device. I called again today and got sent to voicemail. It seems like Gulfstream cuts corners during pool construction and then ignores customers when they have problems, even though we paid $60,000 for their product.
Gulfstream Pools has not fulfilled our contract or expectations, they got $23812.0 from us
Gulfstream Pools has not fulfilled our contract or expectations, they got $23812.0 from us. This letter is to describe in detail our complete dissatisfaction with Gulfstream Pools. We entered into a contract with Gulfstream Pools on June 17, based on information provided to us by Gulfstreams Pools representative, Gary Netwal. We believe Gulfstream Pools fraudulently misrepresented the time frame for construction. Based on the information provided that the pool construction would take 8-12 weeks, we entered into an agreement with Gulfstream Pools. We were told that 1 week after paying our deposit and signing the contract our plans would be submitted to the city for approval. We initially thought that we would install the pavers and subsequently changed our mind, creating a 5-day delay. We submitted the plan to Gary for the pavers on June 22. At the latest, the plans should have been submitted by July 1. The plan was not submitted to the City until August 26, eight weeks after what we were told and what was agreed upon. We were told that construction on the pool would begin within 7-10 after receiving the permit. The construction of our pool did not commence until September 23, fourteen weeks after contract signing. Gulfstream knowingly misled us by providing false information in an effort to gain our business. Gulfstream Pools has been grossly incompetent and negligent. Gulfstream Pools' bobcat operator damaged the reclaimed water valve. Water was pouring out of the ground and your company did nothing to investigate the cause. We contacted the City of St. Petersburg to do the repair. We had identified the locations of two sewer cleanout pipes to Gary at our site layout meeting. The bobcat operator broke the sewer cleanout adjacent to the house. The pipe was laying on the ground, broken off, in clear sight, yet it required us contacting your office for a representative from your company to repair the broken pipe. The crew who showed up at our house had no idea where to look and it required two trips to get it repaired. During the digging of the pool, the sewer line running from the house to the back line was broken. The crew then cut the line behind the rebar. This created a situation where raw sewage was pouring into the hole and being pumped out into the street and into the stormwater. Again, we had identified the location of the pipes to Gary at our walkthrough. This is completely unacceptable. Once the pipe was broken, someone from your company should have verified the pipe was active. This could have been easily done by using the hose to pour water in the pipe from the cleanout at the house. On Tuesday, November 17, Hurricane Eta was in the Gulf of Mexico and very possibly heading to the St. Pete area. Gulfstream Pools drained the water in the pool on Tuesday. We now have two areas where the concrete is being sprayed around the sewer pipes. We will be hiring an engineer to determine the integrity of the situation and provide an expert opinion. We will also be hiring a plumber. After speaking with Ted yesterday, October 13, we were informed that Gulfstream Pools is having weekly meetings about the significant delays in construction. Based on the information provided by Ted, it appears that Gulfstream Pools is having supply issues. You as the owner of Gulfstream Pools either knew or should have known that the increased demand for pools would create a supply shortage and made the appropriate adjustments. If as your customers, we would have been given the information and the option to prepay for items such as pavers in order to eliminate the delay in construction, we would have made informed choices. By withholding information, you as the owner of the company made decisions that are not in the best interest of your customers. Ted also informed us that he sees no way for our pool to be completed by Thanksgiving, November 26. Thanksgiving is 23 weeks, twice as long as Gulfstream Pools represented after contract signing and 11 weeks after the estimated completion date.
