On December 09, 2023, I was towed from the property Willow Lake. I bought a brand new car and was parked in my common handicap spot. The only thing the receipt said was "handicap parking". To my knowledge, tow truck companies cannot tow a vehicle parked in a handicap parking space. Either the rental property or the tow truck driver must call the local police department first so they can issue a ticket and then tow the vehicle. Tow truck company can only act on the rental properties rules or stipulations. My parking pass was clearly shown in the front window.
I have not read the parking enforcent rules, because the parking enforcement section is missing from my file. There was also a car next to me in the other handicap parking space. This person did not have the required parking permit. This person was not ticketed or towed.
I don't beleive tow truck companies can enforce local and state laws. What should have happened is that the police should have been notified and gave me a ticket. Then the police can authorized a tow.
The rental office denied the claim that they called the police or tow truck company. The tow company called Freestate Towing sits at the top of the entrance and searches cars to be towed. This is not good for you to allow tow truck companies to tow a renter from a handicap space without prior knowledge. Since this is a civil matter, the police said I need to sue Willow Lake and the property managment and the tow truck company.
What can we do to solve this issue?
Claimed loss: $175 for the illegal tow $100 for an alignment
Desired outcome: $275 for the incident.
