I am writing to appeal the decision for a denial on a homeowner’s claim, [protected]. I am sending the letter of denial, see attached, to show I was denied due to rot and maintenance on my policy. If you will look at the estimate provided there was nothing about rot or maintenance on the estimate.
On September the 27 or around that time, I noticed that the floor in my second bathroom had become soft. I immediately started looking for someone to try and find out why, since I could not find water leak anywhere in that bathroom. A week later I finally found someone to get up under my house. They found that the seal around the toilet had leaked and caused mold and decay of not only the floor but the floor joist . When I spoke with Dewayne Smith, in the claims, he stated that it was considered a preexisting condition and that I was denied support from Allstate. He also stated that the amount of mold under that floor told them the water had been leaking a long while. According to my contractor that is not true, which by the way I was also told that my Contractor Tom Brown would be contacted, and he never heard from anyone at Allstate. Which didn’t surprise me after the way the whole thing was handled. There was no inspection by Allstate, and I was denied the same day everything was submitted. Also, I was called after writing a complaint to the main office of Allstate and they couldn’t even find where the claim had been filed. It is in my policy under not covered that Spill over and flooding are not covered, and this was a leak not either of those.
If I had had a water pipe to burst in my home or with an appliance, are you saying that will be denied to? It was also pretty much suggested that I have someone to look under my house regularly to make sure there is no problems. I can promise you that no one does this unless something happens to warrant hiring someone to see what is going on.
I have attached pictures of the damage of the underneath structure of my home as well as a copy of the amount it cost to fix my bathroom, I also had to buy new flooring because the flooring I had was no longer in stock.
I have been with Allstate for over 25 years and have never seen anything like this. I have consulted with an attorney and was asked to send a final letter asking for this claim to be reconsidered due to the lack of inconsistencies in the reasoning behind the claim denial and phone calls with the claims department. The claims department also stated that if the leak had just happened that I would have gotten coverage. The claim was filed as soon as the leak was found. After 25 years of being a loyal customer with Allstate I am seeking another insurance company. I am sure that means very little to you all.
I have also filed a complaint with TN Government Insurance complaints. This is third email to Mr. Burns and received no response, this time I included Stacy my actual agent.
