Fraud / false advertisement / deception
Part of Camella's marketing strategy is giving away free gift checks (30K All Home GC) once you avail a unit. Come loan release, this committed GC was not given to us as they now insist that it is only applicable for Bank Financing. Our loan term is in-house, which now they say is not covered by this promotion. This was not disclosed from the onset, and not written in any document.

Greetings!
I am writing this letter to request your good office for the waiver of my interest payments starting from January to July 2020.
Here are the facts of my case:
1. I finished paying my P100, 0000.00 equity for Brielle Townhouse- Lessandra.
2. I decided to continue paying my monthly payments from January to July 2020, thinking that this will be applied against my principal.
3. In July 2020, I went to your office asking how to proceed with the loan or bank financing. However at that time, I was informed that BDO cannot process the loan since the house has not reached 5% completion.
4. I asked the cashier if I can pay a lump sum to lower my principal. It was then that I was informed that out of the P10, 000.00+ that I was paying monthly, only 10% is applied to the principal amount, or roughly the interest comprises of 90% out of the total payments. I paid more than P60, 000.00 in 6 months, and Camella decided without informing me to deduct P55, 000.00 as interest.
5. I told her, I was not informed about this, she said that this so called intermittent interest was just applied this year, 2020.
6. I asked her if I can talk to the person-in-charge, but she said such person was not available.
Now I am asking for your consideration regarding these questionable interest based on the following grounds, to wit;
1. No Consent from the undersigned.
There was no consent on my part, I have not consented to this intermittent interest, in fact I only heard it in July 2020, moreover, the broker who facilitated my transaction and who was with me at that time, didn't know either of this interest. Under the Civil Code of the Philippines, Article 1318 provides that there is no contract unless the following requisites concur, one of them is consent of the contracting parties.
Hence, there was no meeting of the minds because I have not concurred to this interest.
2. The intermittent interest on the Contract of Adhesion, is obscure, and was never explained.
Now it may be argued that it is stated in your contract, but I don't have a copy of such contract, and this intermittent interest was never explained to me. I was told that everything will be explained once there is signing of the loan contract, which has not happened yet in my case.
In the case of Polotan v CA, GR No. 119379, the court held that, "a contract of adhesion is one in which one of the contracting parties imposes a ready-made form of contract which the other party may accept or reject, but cannot modify. One party prepares the stipulation in the contract, while the other party merely affixes his signature or his "adhesion" thereto, giving no room for negotiation and depriving the latter of the opportunity to bargain on equal footing."
In addition, "any contract which appears to be heavily weighed in favor of one of the parties so as to lead to an unconscionable result is void. Any stipulation regarding the validity or compliance of the contract which is left solely to the will of one of the parties, is likewise, invalid."
In this case, this intermittent interest is left solely to the will of Camella Homes Gensan, there was no explanation given or warning given to the undersigned about this clause.
Furthermore, the provision on this interest is obscure and ambiguous and not susceptible of reasonable interpretation. This is a technical term which is beyond the ken of an ordinary layman. I have already searched in "google", the term "intermittent interest", but I was not able to find its meaning.
3. The 90% interest charge of the monthly payments is oppressive and unconscionable.
The legal interest rate in the Philippines is only 12% per annum. Under Central Bank Circular No. 905, "the stipulated interest rates are illegal if they are unconscionable". The court held time and time again that interest rates may be voided if it is unconscionable. In addition, the interest is oppressive since the representative claimed that there was always this clause on every contract, but it was only applied in the year 2020, Camella never applied this interest scheme before to anyone. 90% of my payments was applied to interest while I was led to believe that I was still paying to reduce the principal
4. Imposition of interest when there is breach of contract on Camella's part.
As far as my understanding permits, my obligation is to pay Camella Gensan the monthly amortization, and Camella for its part is obligated to construct the building. However, Camella started imposing penalties in January 2020, when in July 2020, it has not yet completed even 5% of the building. I was informed in July 2020, through their cashier that I have to prepare my documents for the loan in BDO, but at the same time, the loan cannot proceed, because the building does not have 5% completion.
Under the law, a breach of contract is defined as failure of any party to fulfill the terms of a contract without a lawful excuse. Clearly, since Camella was not able to fulfill its obligation, it committed a breach of the contract it made and should not be allowed to impose interest either for my alleged failure to sign a contract of loan, when in the first place, its non-fulfillment of the obligation, is the cause why I cannot proceed to process the loan agreement.
5. Interest Imposed amidst pandemic
As earlier stated, it was only in 2020, when Camella started to implement this interest. The undersigned urge Camella to reconsider the implementation, because the whole world is experiencing the effects of COVID-19 during these times, particularly, the City of General Santos implemented a hard lockdown from March to May 2020.
6. Good Faith of the undersigned
The undersigned fulfilled the payments, and even offered to pay a bigger sum to reduce the principal amount. If I have been aware of this intermittent interest, I would have not paid to Camella directly, and waited for the bank and Camella to finalize the loan agreement. That way, Camella would not have been able to impose such interest, and the payment I made could have been paid directly to the bank as lump sum to reduce the principal.
Before the issue of interest, the undersigned has been consistently trying to contact Camella and paying the obligations. It was only after knowledge of this interest scheme, that made the undersigned disappointed for lack of understanding and action on Camella's part.
7. Breach of contract
It was established that Camella failed to complete 5% of the house unit, thereby, making it the sole reason why the undersigned cannot proceed with the loan
I feel like this interest scheme is a scam that should be look upon by the administration. I believe that prior to advertising an affordable home, Camella should inform their buyers of such policy as to avoid future conflicts with the would-be buyers.
P55, 000.00 as payment for interest, which is not even my fault, since Camella did not build a house yet so how can I contract a loan, is too much. P55, 000.00 might be nothing to you, but for me, a mere government employee, this is 3 months of hard work.
However, at this time, the undersigned is willing to settle, cooperate and proceed with the signing of the loan contract once the interest, subject of this letter is waived. However, if this is not possible, I would also like to exhaust all my administrative remedies, and if need be, I would like to seek the remedies offered by the court of the Philippines.
I believe that in line with Camella Homes' vision/mission to create home opportunities for thousands of Filipino families by setting standards in quality and service, and as such, if anything can be resolved in the administrative level, would be resolved to protect the said home opportunity being offered to the undersigned.

I have same issues as Abby888. This is about a Camella house and lot purchased in Davao City. I was encouraged to pay more after my down payment thinking it would lessen the amount of the principal. When I asked for the statement of account, I was dismayed at the interest they deducted on my payments. I was told I was approved for their 8% bank financing when I don’t have application for such. I was told to file for waiver of interest and up to now, I haven’t heard of a response. I’m at a loss now if I should continue to pay my monthly’ amortization’ when the payments with interests are still in question?

Hello! Even if you wait for the bank loan release, they will incur cost for penalties and interest. Since we have an approve bank loan application and now on the loan release status on the bank, they cleared all the penalties and interest. But when we decided to transfer our account to someone so he can continue the payment, Camella would like us to pay for the interest. We're coordinating it with them but until now, they can't give us an explanation. We're too tired to communicate with them and can't handle the company's inconsistencies and negligence anymore. My loan matured already from cbs
I have a unit in camella leyte this is in house facility payment. My loan is matured already last may 2020 after 10 years, I dont have any pending payments. Until now I am communicating with china savings banks but they keep on changing requirements that until now they are not releasing my original loan documents.?
Cbs doesnt have the copy of my camella cts? What a bank. And when I asked them a copy of my cts they have my condo cts which is never connected with my loan? The bank answered if the developer doesnt have the cts they make a new one! Whatttttttttttttttttttttttttttttttt?

Bayad na ng bank namin ang HL, and now we are processing the refund ng overpayment namin worth 120k+ pero awa ng Diyos wala pa din. March nagfill up na ng application para sa Meralco, and sa kamalasan, natengga sa Alabang yong form. Expected mo tumatakbo na ang 60 days mo. Yun pla, inaamag na sa opisina ng kung sino mang nagreceive nung application form namin. Tonetoneladang bato na yong pnukpok ko sa ulo ko mula nung bumili kami sa inyo ng bahay. Same sentiments here. The unit that I availed is a reopen. It's been 3 yrs but the title is still under the 1st owner. Again it's been 3 yrs since I availed it but we still don't have MERALCO. The engineer said that I have to settle the amelyar first. Upon checking the property is still not under my name. I opted not to pay until it's transferred to my name. I went to the office to file my concern. They just give me the contact info of the account officer. I've sent 3 email messages but until I don't receive any reply. Drainage clogging
Our drainage in camella homes taal batangas are all cloging ..we cant use our comfort room .because all the water in drainage are going to our safery tank..pls do some action regarding this matter
Electricity tapping for our unit in the islands park camella dasmarinas
Our unit was turned over last year and we processed and paid the installation of meralco right away. I think it was around January 2021 when the meralco meter was placed since then I have been religiously following up with the HOA Admin and Camella main office as to when will they tap the electricity inside the house. The wire connecting from the post to inside our house is still not connected. I escalated it to HOA and then to Camella main office but I have been tossed around to different people but at the end of they day still no update still no electricity.
Yung pagkuha nitong unit feels like kumuha ako ng batong ipupokpok ko sa ulo ko sa dami ng issue at walang direksyon. After mo magbyad iiwan ka nalang sa ere, figure out mo paano mo hahabaan pasensya mo sa mga Camella officials, engineers and admin na pagpapasa pasahan ka na lang.
Hoping this will feedback will reach those people in charge and get my request for electricity tapping done.
House and lot
We started paying for Camella Cielo in San Jose del Monte, Bulacan last April 2018. Our unit is Criselle- block 16 lot 24. It was a pre-selling then. But they said that you can move in once you completed the downpayment. It's been 3 years now and yet no house has been built. We are already paying for the house. They did not give us a follow-up unless we ask for it, or most of the time, no reply at all. They keep on giving us the same reason that the land is not buildable yet; They even reason out the pandemic. But the ECQ happened only last year. Two years passed during that time and yet even the land is not ready. Now, they want us to pay with interest.

Same thing happen to us. Weve waited for more than a year before they started the house construction. As of today it was 61% completed. Downpayment completed as of dec 2019. And i paid the full year 2020 of monthly amortization. When i checked the ledger im surprised they charged interest charges, the audacity! They delayed house construction and now theyre billing interest charges! Unacceptable

House and lot title
I paid my unit last feb 2017... And until now, camella management cannot give me my title. They said it was lost and it is in the court for the title issuance. As far as I know, it took 6months only for the re-institution of title. But until now, they still keep on tellimg me that its still in the court. Sometimes, I suspected that they use my unit to get loan from the bank. Though, I cannot confirm it yet in hlurb because I am an ofw.

camella cannot give you your title because the bank has it. the bank has the original title until your unit is paidoff. Now you said that u paid it off fully; its hard to believe that its fully paid off. I have a house here at camella pampanga that was fully paid and i got my original title from camella within 6 months ; no bank was involved straight spot cash. So in essence, camella is not giving u a hard time; once they are fully paid then if u paid spot cash; u get ur original title within 6months like me. If you have bank financing; well you'd better get on them kasi they hold your original title and they are the one's that will remove the lien on your title if its fully paid.

Yes. Its fully paid. The bank already issued certificate of full payment and copies of collateral documents (guarantee letter from camella) has returned to me and to camella . Bank said that i should coordinate in Camella for the title processing. Yet until now, still no words from them. Staff in-charged in my account just keep on promising.

I acquired preselling property last 2018 and paid extended DP until now walang construction, 2021 na. Sinasabi pandemic daw kaya nadelay yun pala ganito na talaga years ago. Biggest mistake of my life talaga. Trying ako na marefund almost 300k and they are offering 50k and mind you sabi pa financial assistance daw ng mgt. OMG Unbelievable. Sana po may magconnect sa inyo na may case or makahelp. Scam po talaga ang Camella, Camella Provence Malolos po kami.

The checks issued was lost..no action ayaw makipag usap ng maayos puro wait until now hindi parin tapos yung unit hindi raw nagbabayad eh nasa kanila mga checks nawala nila tapos kami pa mag pepenalty. I am complaining the low standard of housing construction
A year ago, e purchased a unit in Camella Pampanga Lot 9 Unit 14. I am an OFW and have lived in my unit for only at least 2 months within the year. Few months ago, our caretaker informed us that yung sementadong pasamano sa second floor e kusang bumagsak at nabasag mga paso sa ibaba. This was reported to the Eng Mayjane and Precious Legaspi Manger of camella admin in Pampanga. But no action weas taken till now.
This 14 March our caretaker reported that while washing his hands on kitchen lavatory, nagbagsakan daw po mga tiles ng libabo. We presume na malabnaw po ang timpla ng sementong ginamit kaya nagkaganon. Kung ganon po may possibility na maaring ding bumagsak ang kisame. Ang dinding po sa may libabo ay nabiyak din. This is very dangerous po. Buti na lang at wala pang nakatira doon. Napaka low standard naman po ang ginamit sa conetruction ng bahay. Paki check po t seryosong bagay po ito bago pa may maaksidente o mamatay.

hindi po maayos ang pagmimix nila ng aggregate kaya ang result nagbibitak bitak or nag crack agad. same din po sa ongoing construction ng bahay ko ngayon. Naiintindihan ko na hindi ganun ka high standard yung materyales pero yunf workmanship sobrang pabara bara na lang.
i advise you to get another caretaker kasi first of all in my opinion mabigat ang kamay nya sa loob ng house mo. The caretaker really don't give a rat's [censored] about your house kasi hindi sya meari. So do yourself a favor GET A NEW CARETAKER!
I also bought 1 unit from Lessandra Bacoor. The house has a very low quality. The window cannot closed properly from the time they turnover it and tricked us to received it first and they will settle the issues the following week. But they never repair it and they just keep on promising until I fed up on them. I just hired people to get it repaired since the engineer-in-charged was very u professional.
Customer service is terrible
Stay away from this company! They're bunch of crooks! Think thousands of times before making any transaction with them.

its a matter of opinion, i have a house with camella here in pampanga; i have had no problems customer service nor have i had any problems with the construction here. Dont judge the company because of some personal misunderstanding . There are many people working for camella that are good decent people.
Water / wood design / pipe
Until now wala pa din water. Need to go to the clubhouse para kumuha ng water. Daming problems sa designs ng house from wood na design sa harap ng bahay na nahuhulog pati yung pipe na mali maling designs pag malakas ulan bumabaha sa toilet at dirty kitchen. Kadiri baho need pang maglimas. Yung admin staffs lalo na yung engineer hindi ma contact at hindi humaharap pag pinapatawag. Camella baliuag improve niyo yung customer service niyo. Homeowners kame pero parang mas gusto niyo kame pa sumunod sa inyo. Sigh.

Its been almost 3 years pero wala pa rin tubig sa phase 6 ng camella baliuag.. puro pangako.. mga nakatira nga sa camella nag iigib naman.. karamihan samin ofw ang asawa so sino nag iigib kaming mga misis.. nagbuhuhat ng mabigat everyday! Ano ba naman camella! Nagbabayad naman kami ng tama pero pinapahirapan nyo. Napkabagal mag linya ng tubig. Pila balde na nag iigib sa clubhouse nyo. Homeowners nagiigib! Terible!
They give me penalty.. Since I cannot pay due to pandemic issue with coronavirus..
They send me a computation of my bill with penalties that is equivalent to my downpayment (my unpaid downpayment is 251, 916 pesos and my penalties is 248, 226.48) I was unable to pay my monthly downpayment due to lockdown here in Kuwait..

We've gone through ECQ, MECQ, MGCQ, MECQ again and now we are on GCQ and the Account Officer haven't replied to my email, not even once. I got my approval from the bank last February, but why am I still paying for the Interim Ammortization? If I don't get any reply for this message, I will file a complaint with the HLURB regarding the incompetence of the Camella Alabang office as a whole.
