Midland Credit Management [MCM] wrong person

I received a call about 1 week ago from someone saying that they where from MCM. I asked them how where they looking for? The person advised me that this was a very important matter and was trying to reach my cousin who is a male. I asked him if he wanted to leave a number and name and I will give the message to my cousin. He left the number [protected] and an ext #. On Sept 5, 2011 my cousin called this company and gave them permission to speak to me. I went online and found out that this company was Midland Credit Management. I asked the representative what this was about? He advised me that this was in regards to an unpaid bill for a credit card. I then asked him who was the original creditor? He gave me the name of the card company saying they purchased this account from the card company and now are attempting to collect it. I asked him where there were from. he advised me that they are out of India. and they have several locations here in the US. He advised me that there address is in San Diego CA. On Aero Drive. I asked him the amount of the debt. He told me what was owed. I told him during the call that my cousin said he did not owe any card companies. I asked him how he got this number. he refuse to tell me. But what he did not know is I know how he got it. These companies use a method called skip tracing. They found someone they thought that me be the possible debtor they where looking for. I then was put on hold by the rep because I asked him if was sure he had the correct person. He then became afraid and put a supervisor on the phone with me who them gave me the debtors credit card number. I could not believe that this supervisor did not verify who was speaking with before giving up this kind of information that could possibly lead to an identity theft. If it feel into the hands of a thief. Then I asked him if who he was looking for he them changed his story and asked for a girl with the same last name as my cousin. I advised him that my cousin owes nothing to them and he threatened me saying that if I did not take care of this he would come after me. I advise him to go right ahead and do whatever he wanted to. He hung up. I called him back and asked him if he was crazy? I told him Now I will come after you. I filed a complaint with the better business bureau today, I also contacted the Federal trade commission. I called an attorney with the FDCPA to get more contacts to expose the negligence of this company. I would think that anyone who reads this would not appreciate there credit card or financial information being given to strangers. I hope that this complaint board will look into this matter to help future victims of bad collection agencies who hire untrained people and so called supervisors to collect. Here is a link for more info that Midland involved with. http://www.collectorsexposed.com/forum/index.php/topic/3753-midland-credit-management-response-to-the-minnesota-ags-lawsuit-james-brandon-black/ ...also they have been sued by attorney's in the past from Minnesota Sincerely, Concerned citizen

Midland Credit Management [MCM] Wrong Number

I have been getting phone calls from these people for over four months. They keep asking for an entirely different person. I have had this cell phone number for over four years and this is the first time this has happened. I have repeatedly asked them to stop calling and have been told that they are sorry and will take me off the list. I get up at 4 am so calls after 8 at night are extremely annoying. I don't have cell phone service at work so they just call over and over and hang up and still continue to call even though my voicemail has the name of a completely different person. They started calling again yesterday and called me at 8 am this morning. I am recovering from surgery and have a really difficult time getting rest. I flew off the handle and was told they have never called me before. The supervisor was very nasty with me. Good thing I have documented the time and date and subject of every conversation. I am fed up with this and am now going to take action. I have worked too hard to clean up my credit to get harassed by someone else's nasty bill collectors.

I found a negative report from MCM on my credit report and immediately disputed it as it was for a debt I do not owe.

Then while waiting for the dispute to be resolved MCM wrote to me asking me to provide them with proof that the debt was paid! Nowhere in the letter was there any reference to the reason for the dispute ie it wasn't mine!

I tried phoning them only to be told I was a liar and they would ruin my credit if I didn't pay. I politely told the rep (Wendy) to check on the law regarding fair collection practice and she hung up.

Their whole attitude was it was up to me to prove to them that this debt was paid or someone else's which is not what the law states. It's up to them to prove that the debt is valid and within the statute of limitations. Needless to say their negative report has now miraculously vanished from all three of the credit reporting agencies files lol.

So if you find a negative on your credit report from them dispute it and sit back and enjoy it when they attempt to prove it's valid ;)

They are bottom feeders. They buy ol debts, many of which have been paid or are so old you ont legally owe them any more. Then they torment you or who ever has your ol phone number until you/they finally give in and pay. Then they come up with additional"fees" such as hanling, telephone, interest, etc an start tormenting you all over again. Clark Howard has some great info about them and their fellow slimeballs on his webpage.

Midland Credit Management [MCM] I get calls from them like 15 times a day!

This is so out of reach to comprehend. I answer and they ask is this so and so then hung up. I don't owe them. I did a credit check they are not listed as owning one thing of mine. I'll just change my number then they can try to find me, don't know how they got it in the first place when it's private. And If I did owe anything it's been over seven years and thats the limit unless they extend it to 10 well I own nothing so let them try to take nothing they will gain nothing from me.

First, if you don't recognize the debt and believe that you don't owe the debt, you should dispute the debt in court. Second, if the debt is stale, ie., more than 5 years and depending on your state, you should tell the court that and should not pay or settle the debt. If you need legal representation, you should contact an attorney. You can get some information here, www [dot] connectconsumer [dot] net.

Midland Credit Management [MCM] Illegal Practices

Midland began calling me about a debt they say I owe from 2004. I stated that I had to knowledge of any debt with that company. Later, I sent a certified letter asking for verification of this debt, which they never responded to. They continued to call, multiple times a day, everyday. It was always from a private number, so I began answering it. The representatives would ask for me by first name and fail to state theirs or that of the company they are calling with. After asking, they would finally give me a name like "Scott Jones", however with their limited english speaking ability I found that unlikely. This continued for weeks until I sent a letter demanding that they refrain from calling. For nearly two weeks after receiving this letter, they didnt call at all. Then suddenly, they started calling at the same rate they were before.

I already knew that they had gotten it, because it was also certified through the USPS and signed for by their mail room. I also know that they have to honor that upon receiving it, which they did and then for some reason started calling again. When I got a representative on the phone, I stated that they had received such a letter and that they were in violation. He stated that he had no record of it and I then explained the date and time. At that time, I asked for a supervisor, which he found one. This person got on the phone and told me that same thing that the other one did. There was no record of such a document, and stated that they were calling about (blank debt). At one point he began asking me if I was going to pay it, and if there was a reason of why I couldnt pay it. I told him I was not calling about that debt, as I had already disputed it with them and asked for validation. It ended with him hanging up on me. So I called right back and was transferred to the same guy that was calling me 6 times a day. I told him that I wanted to speak with another supervisor and told him what had happened with the other one. He got someone else on the phone and I had to explain the situation with them calling me after being requested not to and stated that they were in violation. I also had to explain what the supervisor had said and done, and at this time he told me that he had spoken with that person and that this person had said that "it was mutually agreed" that the conversation was over. I denied this and asked him to listen to a recording of the call, as I know they do this. He agreed to take a verbal statement demanding that they not call me. He also said that they would investigate and respond to the concerns with their employees and that was it.

At some point, I ended up taking to someone else in another department to find out what happened to the letter I sent and try to settle the issues that I had with them directly. The woman told me that it takes 30 days to update their systems after receiving the letter and that it would be why they are still calling. I reminded her that the activity has to cease upon receipt, to which she had no response. I also asked why there were no called for 2 weeks following the letter, and she simply stated that they must have ceased collection activity. She continued by asking if there was anything else she could help me with, to which i responsded that she hadnt helped me with the present issues and the conversation ended.

Following that I filed a complaint with the BBB, explaining what had happened. Then followed with the attorney generals office and FTC. Their response to the BBB was vague as explaining what the debt was for, which they already told me. It also included that they are investigating the actions of the employees because it is against "company policy" and a restatement of something I had in the complaint. I have been going back and forth with the BBB on why this response isnt sufficient, to which they keep asking what my requests are and stating that they are unsure of what concerns I have with their response. I have already explained that it doesnt address any of the concerns contained in my original complaint and therefore cannot be found acceptable. The attorney generals office has responded to me, stating that they are in contact with the company in an effort to resolve this. However, it also stated that if they are unwilling to respond, I may have to resort to private legal action. However, this is still up in the air as of today. I dont think I have ever gotten a response from the FTC, so I dont plan on it.

They have been fighting me every step, eventhough they are the ones who are in violation of the law. I have never had to deal with such an unprofessional company in my life. I hope I never have to deal with them again in the future. They should not be allowed to conduct business in the manner that they do.

Midland Credit Management [MCM] Bad service

This company is the worst collection company in the world. When you try to call and resolve the problem you have representatives that instead of trying to help you resolve the problem, they want to talk to you as though you are 5 years old. This debt that I have is very old, because of a lot back and forth with the orginial company, which never sent me out the settlement contract to get this debt paid. This debt has now been sold and resold to everybody's mother, brother, aunt, uncle and cousin. Too make a long story I called in to get the bill resolved and everything that I asked to possibly do, I was shut down. I spoke to a Ms. Martinez and had already explained to her how nasty another person of her company so that she doesn't do the same thing...what do you think she did the same exact thing wanting to talk with me as though I was five, then has the nerve to say I am going to put on hold until you calm down, as though I was getting a time out, but yet she wanted to talk to me any kinda way. I called back agaiin to speak with another representative only to be put on hold for 10 Looooooooooooooooooong minutes while they sit and talk amongst themselves. Mr. Tahile gets on the phone and do the very same thing that the other representatives and did and started going off as well. He said well you called this month so we want money this month, although I was telling him payments could't start until the 10th of April. Today is the 22 of March, I was asking for 16 days to start he made it sound as though I was asking for the impossible. So I then questioned him and said if I called in April then it wouldn't be no problem and he said, so I said fine I'll call you back in April.. These people have no compassion for other human beings. If I had talk to someone on the phone the way they talk to people I would have been FIRED ON THE SPOT. It is obvious that they do not have any customer service skills as all and do not know how to deal with the public.

Midland Credit Management [MCM] phone harassment

This company has called my cell phone one day and then my husband's cell phone the next day. They kept saying that we had a debt that they were collecting for. We never had an account with that partiular company. We are practically debt-free and owe nothing on credit cards. These people had our cell phone numbers and my husband's name. They didn't have the correct SSN for my husband. They were calling for our son but wouldn't accept the fact that it was my husband that they were calling. My son said that he doesn't owe them anything. How do we get these people off our cell phones and to stop harrassing us? There was a man who sounded like he was from India or Pakistan and he said that his name was Mike Taylor. He kept talking over me. The man who called my husband wouldn't accept the fact that my husband kept telling him that he was not the person they were looking for. These people are very very rude and obnoxious. It is bad enough to owe money to a debt collector and to be harrased by that collector, but, we don't owe anyone anything! We are paying our bills on time and are not late. How can we get these people off our backs?

Midland Credit Management [MCM] I was never personally served

I was never personally served; I did call them and tell them about the illegal part, then proceeded to offer to pay only what I originally owed. They refused to work with me. I have offered to pay what I really owed to the Co. and the last collector (Midkland told me it was already charged off).

I tried to ask for help before being late the first time and they said “no, we will make more money if we don’t, and we always get the money”. This was by the original creditor. I got a notice when it was to late about court, and could not make it. I am now sending a Request to open Default Judgment. What else can I do.

I can home to find a (what appeared to be a) summons taped to my front door. I have not been previously contacted by this company. Yes the dept is ligit, but now they are serving a summons without previous contact? I feel like they are trying to bully me into payment instead of working something out

Midland Credit Management [MCM] I never received

I never received any notification from First Consumers National Bank. I pulled up my pay information and was being garnished. I called and found out that it was from some attorney Mary Jane Elliot, in Novi, Michigan and I never received a piece of mail from her. Some nasty woman answered the phone and told me that I was sent mail to my ex-husband's address (we've been divorced for over 7 years) and I never resided at his address. I am contacting an attorney that represents the UAW today. This is outrageous and done without prior notification. I think that it is terrible the way the legal system works, allowing someone to sue a person and the person isn't notified.

Midland Credit Management [MCM] Sieze property

How can this company sue someone without having them served to appear in court for suit? I received a judgment for my property and I do not even know what this matter is about and had no contact with this agency!

I am pissed that they are not doing this procedure the legal way! They are skipping all formality and going straight for the jugular! The company name is Midland Credit Funding, LLC. based in Bay City, Michigan. Who do they work for and why are they charging interest for their work to us consumers? I am tired of them!

Midland Credit Management is a subsidiary of Encore Capital. Their Corporate Headquarter/Operations is based in San Diego CA. Their collection calls (the majority) are outsourced to India. They are huge and making money hand over fist. If you go to the Encore Capital website, you will learn a good bit. Not much help, I know...just and FYI. Good Luck~ Samantha

Midland Credit Management [MCM] Rude service

Does anyone know how to stop this company from harassing people? Their phone operators are the ruding people on earth. I have been threatened by them and don't know what to do. They kept asking me my account number - I told them I didn't have one because I didn't know why they were calling me. She kept insisting that I did. I finally told her if she would tell me what the debt was for - maybe I could help her. She said "well, if you pay your bills we wouldn't be calling". What they don't realize is that I do pay my bills. My ex-husband opened charge cards using my name, social securty number and forged my signature on them - ran off and charged his way to crack using cash advances and they don't care. I told them I have a supreme court judge's decision that I am not responsible - she didn't want to hear it - she said that is between you and your ex-husband. Then she hung up on me!

This company has repeatedly called me trying to reach my mother. I've explained it's not her number & she does not have a phone. I've asked for them not to call again, and they still do. I've been hung up on when I try to explain it's not her number. I called back today & asked for a manager & was told I could not speak with one, I tried to explain to Cynthia my request & again was met with rudeness, said she'd remove the number & hung up on me while I was talking. Called back & was told by Maurice that managers will not take calls that I could just leave a message.

Midland Credit management is a SCAM! They are a joke! If you blow them off they will then either start contacting you as Midland Funding and add charges(but it is the same company) or worst case scenario try to take you to court and if they do its an even better situation. Go and challenge it, it will cost them money and chances are they have NOTHING, ZERO so then it will be dismissed but cost them money.

Another favorite of mine and others that have posted is to answer the phone when they call and blow a whistle into the phone, they called you so nothing can be done and at least you get the satisfaction

Again they are a SCAM.

Midland Credit Management [MCM] Credit Collections

Midland credit management continuosly changes the dates on my old debt...this happens every time I pull my credit file and dispute the account.. the date changes to reflect the most recent dispute...as the debt they speak of is at least 15 years old...and in the state of Texas any alleged debt not collected in 4 years is SUPPOSE to be a dead non-collectable debt..However our credit bureaus..continualy allow these ###s to do this...I have written to Midland Credit management and they do not respond...It is my opinion that our credit bureaus are equally to blame for not following the law...

Midland Credit Management [MCM] Bad practice

I was called by MCM non stop on mt cell phone for a past due credit card bill i will admit it is mine and i owe on it and plan on paying it i called them one day on the phone and was asked the basic questions before i started with them i let them know that this conversation is being recorded for my own safety and with in my rights to do so the person who name i did not get told me i do not have the right to record them and hung up on them loved that part again i called and informed them that i was recording this call and asked for there name a phone number i could call them back at and there supervisors name this person did give me the information i had asked for told them that i would me more then happy to pay the amount in full and i asked if i could have the address of there payment dept so i could send a check and a citified letter they told me it had to be a credit or debt *wrong answer * i told them i have this right to send it by mail told them i do not have a credit card or a debit card but i do have checks and if they are refusing a full payment in legal US tender then they are forfeiting on this payment well needless to say he said he would have his supervisor call me been 3 weeks no call my suggestion when dealing with people like this is to tape the call and send the a check certified mail that way you know who got it and you get proof that they got it denying a payment in full if a forfeit in my eyes.

Midland Credit Management [MCM] scammers

Palisades, New Century Financial Services, Inc, Midland Funding and many others are all owned by Pressler & Pressler, 7 Entin Road, Parsippany, NJ 07054. They are corrupt and have many judges paid off. They sit on the committee that makes all the rules for the Special Civil Part of the Law Division Court in New Jersey. Go to google and put in : Pressler & Pressler scam also go to Pressler and Pressler club also another website is defeat Pressler and they will tell you all about the scammers. We should all pick a date and go pick it at the Capital in Trenton. At Governor Christies office. Otherwise it will never get resolved. Nobody listens to 1 person but if we go in a big group they will have to deal with us. email me at [protected]@gmail if you want to make signs and pick it at the Capital in Trenton. How about we pick a date and spread the news. What about December 1 st at 1pm? Let me know if you can show up. Tell everyone on every board that complains about Pressler & Pressler or their companies. Spread the word and RSVP to me so I figure out what kind of numbers we can do it with and if it will be worth it. Thank You and God Bless You All in these stressful and trying times. Dolly

I and my attorney hope the harass me :) I need a few thousand dollars in my pocket from when I sue them. Midland pretty much stays within the Federal laws. They may be breaking some state laws since they are out of Ohio and their so called attorney files in Ohio. If you feel they are doing something illegal, contact an attorney in your state and simply sue Midland. A petition will do nothing, but sending them a lawsuit will :)
