After paying a $15.00 phone service fee every month to pay my mortgage because Americas servicing company had no website is bad enough but to add insult to injury the company now has a website and has the nerve to charge $10.00 to use that service as well. Americas servicing company is ran by a bunch of crooks!

I lost my home because of ASC

I thought I was the only one having problems with ASC, until I was informed to come on this site. The more stories I read, the more it sounds like my current situation with this horrible company. I can’t express the heartache and anger they have created in my life, not to mention the damage they have done. All my problems began when my loan was SOLD to them. JUST AN FYI to those who have a choice to get rid of this company, do it now and quickly. It is only a matter of time before they trap you. Unfortunately, I was too late and had to sell my home !

If I only knew what I know now……..

Please post your information on the [redacted] too (website link - /link removed/ All companies are listed in alphabetic order at the bottom of the page. There are a bunch of people there looking for help and I believe they only stay with this site even though there are so many more.

My favorite website is the Mortgage Servicing Fraud Forum (website link - http://www.msfraud.org/forum.htm) which provides great information. I have posted this link here before and hope that everybody takes advantage of it.

I thank modern technology for the Internet. Without it I would be in the dark, wondering what is happening to me after we got sold to ASC earlier this year. Since then I have educated myself thanks to the Internet and all the people out there who have posted their bad experience and also have given valuable (non-legal) advice.

I am taken back by the recent artical in the New York Times downing country wide, this month they are the largest servicer and originator, next month it will be Wells Fargo Which is Also ASC. Wells Fargo/Asc Also have had mortgages go through foreclosure for forced placed flood (or any other) insurance The reason your not hearing about them in the news Is Bc they dodged a bullet bc this month they are not the largest bank.

Hello Everyone...Its funny to see all of the postings I've viewed just in the few moments ive been on this site. So just to clear up a couple issues you all seem mto be having. I am a rep with ASC... in no way does ASC have to offer free payments online. Its a COURTESY! All to much you've become acustomed to. Do realize ASC is just a servicing company and makes its profit from servicing your mortgages by contract for lenders (the people who gave you your money). And it does beleive it or not cost money to run websites that use other companies copyrights like online payments. There are fees to the company for that so of course we have to recoup our expenses. Managment is well aware of your complaints to this issue, and quite frankly it will change when in changes. So like gas prices just go with the flow if you wnat to continue persuing this payment option. Secondly the company in no way is attempting to scam you. I'm sure you knwo that we are not the US Postal Service and dont regulate the mail. So by the Postmaster his/herself can take up to 7-10 buisness days for mail time. FYI you DO NOT mail 2-3 day mail to a PO BOX! There is another address for this. If you do it will be interdept. mailed and can cause delays but will STILL BE POSTED for the same day recv'd. And also I have to explain this thousands of times...your bill pay is merely a secured check mailed out by your bank! Not a wire transfer to ASC! You still must allow mail time. So of its late see your post office or bank for that issue. All payments rec'vd are posted the same date recvd and reflected the next buisness day in all of our systems, Thats a 24 hr period poeple! . 3rd...If you asessed fees upon a new aquisition (we just got your ln from another servicer) than you WILL NOT get fees or reports on your credit! If there is than it came from your previous servicer and can be handles through our customer service dept. 4th... Your taxes and insurance (aka escrow), if its not on the loan then its YOUR responsibility to make sure they are paid and that your servicing company is aware of it! That would be us..ASC. We dont pull this out of thin air...lets call it notification. Thats what we get from your insurance prvider or tax authority if they are not paid. So being your servicer it is whithin out interest and right to secure the property. Because god forbid your hm burns down and there was no coverage. Would you be upset. And ASC refuses to let Tax leins to replace their 1st postition on the loan. And yes sometimes they are paid and we arent notifed and we already made arrangments...well JUST SEND IN PROOF! and in 1-2 weeks your issue will be resolved. And yes for those of you who dont know how escrow works only in some select states in the US do they allow escrow accounts to accrue interest...THIS IS NOT A CHECKING OR SAVINGS! I'm done for today and will pick up this lesson of mortagage 101 later..hope all this info helps!

About a year ago my loan was sold to ACS my husband lost his job and I fell behind a little trying to pay what I could at the time they would only accept payment in full or not at all this put me behind more the late charges were piling up and they charged me a unexplained 300.00 inspection fee they were also charging me a 30.00 drive by fee for some one to drive by and make sure I lived there bs how do they know what I looked like and there was one for 6 months straight. I hate this company, I am leaving them in jan. I also got a loan through my credit union to catch me up and ACS was not trying to help the credit union. They credit union banker said it felt as if they were trying to get my home . ACS is not helpful and I would joint any law suit out there against them some one should take action good luck to others and I would not use them.

ASC is run by a bunch of crooks. Funny that they are owned by Wells Fargo. I believe that they are trying to get people to default. They always apply our payments late. We've yet to be reported late to the credit bureau. I have 2 loans with them and they call me everyday starting on the 1st harassing me for payment. I have never been more than 30 days late. So this week I get a letter from them that just made me furious. They sent me a letter offering me $2,500 if I put my house on the market before 10/31. Are these people crazy? I'm not selling my place. I just bought it a year ago. They want you to lose your house and dont care for you as a customer. I only have 1 more year to go and bye bye to ASC.

Stop the presses, I have found away to put ASC in the direct line of Fire, Just follow my lead, write a letter to the " Comptroller of the Currency administrator of national banks" google it. Comptroller of the Currency administrator of national banks Customer Assistance Group, FAX [protected], all you need to do is tell your story and back it up with facts, I sent in banks statements from my online payments, I sent the letters from ASC, I sent every document that was involved, they opened a case and sent me a letter stating that they would contact ASC.

Long Story short is ASC, FINALLY acknowledged their own problem and they corrected it! So for all of you please use the info i have provided, what do you have lose.

It's incredible to read all this comments about this company called ASC!. My account also was sold to them and I have been with them for a year and I haven't had any problem so far with the exception of late fees, which really it has been my fault sending them late and I know exactly for sure that I send them late and expected the late fee as well. Anyway I am current with my mortgage now and this month I received a flayer for a preferred payment plan option. I want to pay my house sooner and they offer a weekly payment plan that I wanted to do on my previews mortgage company but they wanted a monthly fee attached to it for like $300 -400 set up fee and then monthly fees for the payment plan option. This flayer says "Our Free Proffered Payment Plan Option". Do you think it will really be free with no set up fees and or monthly fees? I am very interested in scheduling a weekly plan for my mortgage. If someone can give me so advice on this freebie thing so that I can make the right decision I will appreciate it.

I agree with the complaints against this company. One lady wrote about how they did not have enough money in escrow to cover her taxes, so they upped her monthly payment. This year, they are doing that to me for the second time, (they did it last year and told me if I paid it off over two years, I'd be caught up). They only review their records once a year and in that time, taxes can increase and then no one catches it until it's too late, therefore raising the monthly payment. I am 25 years old, fresh out of college and took on the house after my mother died. It's not like I have two incomes or that great of a salary that I can keep affording these monthly increases every year, nor can I afford to put enough money in my account to support the cushion they did not provide themselves when they bought my loan from my original lender.

Wow! I new that something was utterly rotten about this company, but could not convince myself. Now I am. We thought we are only ones being literally tortured by America's Servicing Company. Perhaps, hardworking citizens like us should stand up together and prevent this rogue company from robbing us blind. Since their taking over our mortgage, the rate is increasing by leaps and bounds and soon, we will throw up our hands and run while they take over our property.

I too have HAD IT with this company! I send out my payments before they are due but every month they are considered "late" and it sometimes takes WEEKS for them to deposit my checks! And don't get me started on the $15 "JUST IN TIME" payment! My husband and I are counting down the days that we will refinance our home with ANOTHER LOCAL lender that we know won't get sold to these crooks!

Wow! Not that many months ago I couldn't find anything on the internet for ASC (America's Servicing Company) Now I see there are a lot of people in the same boat we've been in only our situation is worse you might say because we are in the process of working with a local non-profit orgranization that is helping us out of foreclosure. My husband Allan is a disabled veteran. He's been fighting for over 2 years to get his VA disability increased from 30% which amounts to nothing to 100% which they finally decided he is but still have not increased his pay. He did finally get social security disability after his 5 month waiting period turned into 7 months. In the meantime we fell behind in our payments. We have been contacting ASC to no avail. According to HUD and the homeowners rights they should have re-negotiated our loan to where we made up the payments over 18 months, 10 years, or added them onto the end of the loan. They have been unwilling. EVen though we have the money now to catch up they are unwilling to accept any money. We had trouble with our first payment with them. We have a 1st and 2nd mortgage. I sent both checks in the same envelope. WHen the payment for the 1st mortgage didn't clear when the 2nd mortgage check did, I called them. They talked to me like I was some kind of deadbeat and denied having the check. I made a payment electronically over the phone because I didn't want the payment to be late. The next day they not only took the electronic payment but the check also cleared my credit union account. Imagine my shock on payday going to the grocery store and our debit cards wouldn't work. I contacted my credit union the 1st thing Monday morning and luckily I was able to get them to call back the electronic payment otherwise I wouln't have even had any money for gas to get to and from work for 2 weeks. Anyway, we too have had problems on and off with them since day one and now they are totally unwilling to negotiate. Funny thing is we were trying to refinance back in August 2007 to get our payments lowered to where I could afford them on my pay alone. ASC reported we were further behind than we actually were. Up to 90 days we would have been able to refinance and we were only 60 days at that time. What we are finding really interesting is that somehow back in May - 3 months before we had the appraisal done ASC knew what the value was on our house which in case no one posting here knows it's against the law for your mortgage holder to have that information and we are trying to figure out where they got the info and how they knew ahead of time. We suspect that the group we were working with on refinancing with is affiliated. Anyway, they have violated our rights, broken several laws along the way and continue to do so. We are lucky tht we have found someone that will help us out of this mess. We may still be stuck making payments to ASC for another year. WHich I don't expect any of the problems I've seen many of you are having with payments being posted late. I will be paying them via online billpay through my credit union so the payments are documented by a 3rd party. I was doing that before after the problem with the double payment and didn't have any problems. I think they don't dare with the payments being made by my financial institution which by the way is a free service. I'm very, very surprised there isn't a class action suit against this company. I suspect companies like ASC are to blame for the sad sorry state of the home mortgage sub prime loan situation. I don't know who will wind up being our next president. Our lawmakers in Washington DC need to wake up and get legislation passed to outlaw this kind of preditory mortgage business. If they don't get a handle on this our economy is going to be in real sad shape.

I agree with everyone on this comment board and I am so sorry to hear about all the trouble that you are all having. This is the reason I started my company. I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.

I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.

Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?

That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! Oh, man, if I told you some of the stories I have heard...let's just say, it’s not pretty.

I know that some people are going to look at this comment and go, this guy is trying to drum up business. Well, you're right. But here's the kicker. I used to work in mortgage collections. I used to make the phone calls and send the letters. I used to work around the people that make your lives hell. And I kept asking myself, why? Why are these people not being told about the help that’s readily available? Why are these people not being helped to make payment arrangements that are realistic? Why does this company care more about the money than about customer service when that is supposed to be their primary objective?

That's why I got out. I can not stand collections. Just because they are hiding behind a company name they think that they can say anything or act anyway they like with the customers, being friendly with one and the next 40-50 they can treat like crap. Where is the customer service?

I take all that frustration away from you and create solutions that work. I know that it may be hard to swallow, but I do. I have done it for several people. And I can do it for you too. I couldn't figure out what the $10.00 charge was on my recently received bill. It was just marked 'other'. Now that I know I will try to get taken off their web listing. That's outrageous to charge $10 per month to use a web site. My bank, phone company, utilities and other services don't charge for the privilege of using their site. What a rip off!

I can't begin to tell of my problems with ASC! Don't have the time nor tears! I pay my payment online through my bank's "online bill pay "service which is FREE, as I too refuse to pay a fee to them! We are rather "stuck" here. Can't sell our house without losing $ but we lose $ every month paying late fees cuz we can't get ASC to "help" us. We do love our house and wan't to keep it., but the "fight" is emotionally as well as financially draining!

America's Servicing Company is, by far, the worst mortgage company I have ever dealt with.

I have so many complaints regarding the way I've been treated, I don't even know where to to begin!

The only way I even got them to respond to me, is after I reported them to the Better Business Bureau. If anyone wants the BBB address, here it is: BBB of Central and Eastern Iowa, 505 5th Ave., Suite 590, Des Moines, Iowa [protected].

I don't know how a company such as A.S.C. can stay in business, with their shady, unethical ways. Shame on them.

I just received my mortgage statement and I see a 10.00 charge under other charges.I assume it is a charge to pay on line. I do not pay on line.I will call about the fee tomm.They did not give me the option.My mortage was also sold to them. They called me on the 2nd of the month looking for a payment.I told them never to call me about something so crazy.My check was cashed on the 4th.I have owned a couple of homes and have never had any one call me.Also they were late paying my taxes at one point.I will also try to ref. to get rid of them. I have bad vibes about them also

I have alot of problems with this company. My insurance got cancelled by State Farm and ASC provided the insurance which cost more money. So it is not just about making your payment on time but overall service is not very good.

I completely agree with 99.9% of these comments. I understand that we as homeowners have the obligation to ensure our payments are received on time but you pay online it is your basic expectation that this would happen. I have been assesed various late charges because of what I thought was ASC's substandard and technically archaic systems but it wasn't long before I learned that this company is a scam and wha they do has to be illegal. I would also jump on board a class action lawsuit.

asc is the worst, i have an arm that jumoped 1200, they said they could helo, fill out a modification app and wait 2 months, they are backed up . so when they never called me, i kept calling it was the same story . then they denied my deal with no reason and said i could try again in 2 months. bottom line i refied that same week with residential accetance in utah, i saved 1300 a month

I have been fighting with ASC since last Dec. I recieved a letter that my escrow was in the negative by $2900.00, and my payment was going to go up $240.00 a month. After doing some research i found that they overpaid my real estate tax office a sum of $1300.00. I faxed ASC tax office the necessary forms for them to get the refund. They say i have to pay the increase until they get the money refunded. I told them it was their mistake and not mine. I still don't have this resolved. I am refusing to pay the increase. There are some very rude and unconcerning people working there. I have never encounter such people. I also agree that the internet fee is a rip off!

I can't believe this company the one story just about made me cry...we are in the loan modification game its been well over three months and nothing...they told us not to make a payment and so we didn't and everytime i talk to someone its a different story I wish i had found this site sooner i might have logged my conversations...I am worried now after reading some of the complaints that we will be denied, my friend worned me when our loan was sold to them that they are out to forclose that they are making more money off the forclosures but in this economy you would think they would work with you, , , , I am really worried now, and what do ppl mean when they say they filed bankrupcy to avoid forclosure? how does that work?

I agree completely! I would never recommend ASC to anyone... I have multiple rental properties... 31 accounts and the worst I deal with is ASC..and I only have 2 of my mortagages with them.. thank goodness! I have NEVER been able to access my account on line.

Just getting the word out there to EVERYONE! We can do something if we all complain to the right ears rather than on a message board. I have done my homework and found out that we can file complaints with The Federal Trade Commission @ www.ftc.gov. I did mine and it was really easier than I thought! Second, file one with your state Attorney General's office and your state representative. These are the people we put in office to protect our rights! Our tax dollars pay their paychecks...so they work for US! The website to find your is www.house.gov and www. senate.gov. They have to record all complaints and act on them! So let's get the word out to anyone who has ever had any bad dealing with ASC and get the wheels of justice rolling. What they are doing is illegal and they are cheating the consumers that keeps this county afloat! More complaints...More attention! complain, complain, complain!

They are crooks! They took me off of automatic pay without informing me. Then charged me some outrageous fees. They claim that they have a right to stop the automatic system when ever they want. My fees are $20 and today they tried to charge me $30. I asked about the web site and why it would not let me log in. I have never missed a payment with this company except when they did not take out my money. I caught it a day after the late fee kicked in which is the following day when my payment is to be taken out. I to would join any law suit. I never pay the same amount whenever I call. I feel like I am a criminal.

after reading these and other complaints on related websites, I can say that none of you understand the commitment you made when you borrowed the money to purchase your home. you are all under the belief that the loan servicing company and/or mortgage lender is required to accept late payments and provide you with options to bring your loan current through payment plans and loan modifications. you need to sit down and read the terms and conditions of your deed of trust. an escrow account can be established if you do not respond to the servicer when they ask for proof of tax payments made or current hazard insurance. they are required by the deed of trust to ensure the integrity of the property. you need to remember, until you make that last payment on the note, you do not own the property. the lender has a right to protect their interest. also, if you are being serviced by ASC, it's because you are considered a high risk, subprime borrower. your credit scores are in the high 500s to low 600s. this is considered poor credit. the bank or lender has every right to protect themselves from default by charging higher interest rates because you have proven in the past that you will default on your obligations. your note states your payments are due (usually) on the 1st day of the month. there is no grace period (again, read your documents) on a mortgage payment. technically, you are in default on the 2nd day of each month if you have not made your payment. the servicer is not required to accept short payments, interest payments, payments of principle and interest if you have an escrow account. you agreed to the terms of the contract when you wanted funding for your home; but once it became inconvenient to make your payments, you start blaming your servicer for all your troubles. I will agree that any large corporation can and does make mistakes, but certainly not at the level these complaints would have you believe. read these complaints, these people admit they are in default, admit they missed payments and admit they wanted ASC to fix their problems. banks do not want your house. it costs more to foreclosure on a property and have to refurbish it and make all payments for taxes and insurance and maintenance while waiting for the property to sell. the bank makes its money when people perform their loans. that is what the interest is for. I'm sure the majority of you chose to take vacations or buy Christmas presents rather than make your mortgage payments on time. or you lost your jobs and expect the servicer to feel sorry for you. banks are not charitable organizations, they're not your mother. if you can't continue to afford your home, sell it or work two jobs or whatever you have to do to satisfy your obligation. stop whining and grow up. and by the way, ASC is a 'doing business as' of Wells Fargo. Wells Fargo did not purchase ASC; ASC is not a division of Wells Fargo; ASC services all subprime loans, not just Wells Fargo originated loans. if you're going to whine and complain about a company, you should at least know what you're talking about.

if anyone on this website has read the comment before me I am sure you will agree that this person is really a [censored] bag. As a matter of fact he is the a ###. He obviously has to work for this company to defend it so much.. ASC does suck and they need to be shut down! And as being a high risk customer, that is a load of crap, when I got my my mortgage, I didn't even have to show proof of income because my credit was good, so ASC should consider themselves lucky to have us a customers. I am so over these people.. companies like ASC make people not even want to own a home.

I just received a call from ASC telling me that the call is recorded and "this is an attempt to collect a debt" . I said, "What debt?", He said "I am calling to find out how you are going to make your payment and when", "Are you going to do it by next Saturday the 16th?" I said, "Yes, why?", He said, "Well you technically are in default it was due on the 1st". I told him I am a real estate paralegal, have been for 18 years, I am not late nor was I late when I was out of work for 4 mths. so why are you calling?" john henderson is an idiot. whether one can pay their mortgage on time or not has nothing to do with "maturity". many people, many responsible people with good credit got into these loans in good faith to pay them. the economy, the lack there of and or life's screw balls can affect how someone can get behind in their mortgage payment. john, you are a lemming to believe that any mortgage company who has these many complaints, is not at fault. the evidence is resounding! lets hope that you dont get ill or loose your job...or hit by one of life's fast balls. if you do, you wouldnt be so happy to pay all of asc's fraudulant fees. but then again, you are an idiot either way. jack

spades an ###! any ### who had that much time to sit down and write a thousand word plus remark, regarding complaintant of asc, is an ### employee of asc or is an ### employee for asc. hey folks just remember, most of these idiots that we deal with are low level employees of asc who cant afford to own a home themselves. these "customer reps" all around are not very intelligent people, their job position should explain it all. if youre going to loose your home, loose it! if youre late, be late! fight for what you can win. these rats play on your pride and with your livelyhood. do not play their games. finally, spade is a low level manager for asc no doubt. spade, do you know what a hedgefund is? its when banks et al make money on investments that fail i.e. home loans. so dont try to feed these people with this ### that any bank/mortgage co. would rather keep someone in their homes as oppose to loosing their homes.. jack...

This company are crooks have been ripping me off for one year now.After two years I cannot refinance, my 5.8 jump up to 9.9 for six months, then came down to 8.9. I have struggling to pay this and barrowing money from family and I could no longer stand . I went to Wells Fargo because they are the parent of this loan and ask for modification to lower the rate they have turn me down completly. The fact that they already lower the loan. Im hoping that this company well milt down into pieces and all the people who owns this are going have their day. God is not sleeping they will have their turn.

I really hate my loan being handled by ASC. We should have the right to choose whom we want our mortgae to be held with. As far as I am concerned ASC is the worst mortgage servicing company I have ever delt with, they are hard to deal with and they could care less what happens to your home. I have had many problems with them and dealing with their customer service representitives is horrible.
