We have contacted ASC, who is part of Wells Fargo Group. We have written to them with all our details and explain our situation, we contact a Consumer Credit Counselling Service who help us to put a letter together outlining how ASC could help us save our home from foreclosure as the CCCS said not to do a Forbearance Agreement we asked ASC to lower the Mortage Rate from 7.875% and to add our mortgage arrears on the end of our mortage but all they keep coming back are Forbearance Agreements. I have contacted the The White House via e-mail I have also contacted my local Governer Charlie Chris but they are not able to help or they are unwilling to, they need to take a closer look at this companies practices. ASC is not a nice company to deal with can nobody in the USA Governerment help!

I purchased a home in June of 2017, my loan was sold to ASC in October of 2017. From the time it was sold I began having problems with them. My payment due on the 1st but graced til the 15th is usually made around the 10th of the month. My phone began ringing on the 2nd of each month.. regarding payment, this has continued each month. I fell behind for Dec and when I tried to make December's payment on the 2nd of January they declined it saying I must make both payments or none at all. Again the calls continued calls at home calls at work so I faxed over a cease and desist letter telling to contact me via mail and not to call anymore. I also on 16 Jan 07 requested and was granted a repayment option via a forbearance agreement. Yesterday 25 January 07 a ladt rang the doorbell of my home. I noticed she parked in front of a neighbors home and walked over to my house.

I answered the door and she asked if my husband lived here. I said who are you she asked if I was a renter, then I asked again who are you she then again asked for my husband by name. I then tell her my name and she said I have been sent here to give you a message to call your mortgage company and to verify your occupancy at the residence. I asked her again who are you and what mortgage company. She said my name is Michelle and I don't know what company. I was just sent here to tell you to call your mortgage company.

Ok what's wrong with this picture? I cal ASC and they inform me THEY OWN this house and they have a right to send someone to my door if my loan is 30 days past due. They also told me it was irrelevant that I have a repayment plan in place and stated I would be charged a 15 dollar fee for this woman coming to my door!

Can someone PLEASE tell me if this is legal?

I completely agree with you that this is harassment. I have been having the same problem with harassing phone calls at work and home. And it always starts the 2nd of the month, every month. I have never had a problem with any other mortgage company. This has affected my credit report and is driving me insane for them to keep harassing me like this. I have even told my coworkers to tell them that I have been fired for receiving phone calls daily from them. That is very pathetic that a company has this many complaints against them. I have not yet had anyone come to my house yet but I do not see this as being legal that they have done that to you.

Our mortgage, unfortunately, was sold to America's Servicing Company in September of 2017. They have to be one of the worst companies we have ever dealt with. Our payment was due on January 26, 2017- Payment was sent out from our bank on 01/22/2017 and was to be delivered by 01/25/2017. AMC claims that they did not receive the payment until February 2, 2017. After speaking with several rude customer service representatives. I was told several different stories each one contradicting the other. On February 5, 2017 I was told that they did have the payment and it was received on January 26, 2017. Another (rude) representative stated that it was not received until February 2. That it takes 15 days for a payment to reach them through the mail. That I need to send the payment by mail at least 15 days prior to the due date. However, if the payment is received within 2 days they will still cash the payment because they do not recognize post dated checks. I was also informed that a machine opens the payments. However, they know for a fact that the payment was not received until the machine opened it. Which was February 2, 2017. Even though I have documentation from my bank varifying that the payment was sent out well before the due date. Basically, my bank and myself are liars. In the mean time they have charged me additional fees, interest, etc. They also have sent my payment back to me refusing to accept it because it was not received on the due date of January 26, 2017. Today February 8, 2017 I received a letter of acceleration which was dated February 5, 2017. (amazing it only took 3 days by mail--my payment must have been sent via Pony Express). While trying to clear this matter I have been hung up on, shouted at, and treated with absolute disregard. It is such a shame that when your mortgage is sold, we the people paying the money and interest have NO say in the company in which it is bought by.

This IS harassment...I would call the attorney general in which ever state you live...this has to be a violation of the law ...if nothing else, call the law school in your area and see if there isn't someone there you could talk to if you can't afford to seek counsel on your own...talk to the Better Business Bureau...check out various websites to see if you can find any information there about this style of harassment and/or the option of the cease and desist order.

Wow they done the same exact thing too me, I wish it was something that we can do too... stop this... only thing that we can do is pray that it will get better...my suggestion would be too try too, refinance your home. My credit is so bad now I can't refinance. This is very shocking to me. Today when I log on too the computer, I had no clue that I would have to read something so horrible. I work very hard to keep my house, as a single women, and the fact that they, are always sending me foreclosure, paperwork drives me insane.

America's Servicing Company aka ASC has received my payment on time but charged a late fee to my account on 5 different occasions. I was mailing my payment via U.S. mail 1 week prior to the due date. This payment was mailed from Pasadena CA to Los Angeles CA, you would expect this to be more than sufficient time for my payment to arrive. Well it wasn't according to ASC and I had no proof. The following 5 months I began to send the payment via UPS overnight delivery... I was still assessed a late fee! My payment was received on time and this time I had proof with UPS's confirmation print out. As of today I'm still waiting for ASC to reverse the late fees they erroneously charged to my account.

I work in the mortgage industry as a branch manager of a mortgage company. We originated our loan with Option One who then transferred servicing to ASC. I have always paid my mortgage on the 5th of the month and had it automatically withdrawn with Option One. When they transferred servicing, I tried to set it up the same way, but would have to pay $15- $20 per transaction, which would be $240.00 more a year for fees that are non- deductible. They start calling on the 2nd of the month, 3 times a day, even though I have told them again and again this is when I will pay. Here is the kicker though, when they receive my check,they electronically withdraw it at no fee? How stupid is that, charge me for internet and phone payments but do the same thing if I send a check? Predatory collecting is what I call it. With the market in the turmoil that it is in, I think there needs to be a government investigation into the Loan Servicing Companies pronto.

I was behind a couple of months in my mortgage payments so i called ASC to make a payment to get back in my feet. The representative that assisted me ask what was the reason my payments were behind. As i previously advise them the relocation of my family from California to Texas was not the best therefore we were for a couple of months financially bad. She then told me the following, "Well Mr. Herrera it seems that you should prioritize those payment, and shopping sprees. I think that you would be better leaving your debit card at home and trying to stick to a budget. The 99C store my be a good place for your home necessities" This was a slap in the face who does she think she is to tell me how to run hi home she is just there to take a payment and that's all. That was the reason i called her not to hear how should i run my household. I planned to get legal assistance to pursue against this cheap collection practices.

This company is the worst. They do the same thing to me. But, they also put my payments in "Suspense" and try to throw you into foreclosure and charge you a $95.00 fee for "Brokers Buy Option". When your payments are in Suspense, you cant pay them online (then you have to pay their $10.00 fee) you have to call and listen to their recording that they are trying to collect a debt... I have been disputing late fees for a while and now this Broker thing. I HATE THIS COMPANY.

This is the second time that I have had the horrible honor of having a loan through this company. The first time I refinanced my home just to get away from them and much to my chagrin ended up with them yet again. The customer service sucks. They don't back up a single word that their representatives say. They call your house relentlessly, even if you have a payment scheduled. I understand that this is a sub prime lender, but we aren't all ###. I am so sick of having to deal with this company and their overblown charges. $15 to pay by phone, $20 if you talk to a human, and $10 to pay via internet? What kind of ### is that? Who charges you to pay by internet? I hate this company, and will do anything I have to in order to get away from these oppressors.

Me too. Then they try to treat me like a penny pincher. Its not the money its the overcharging its just not right. The worst customer service, if you can get to them. Its a crime the way this co works ( or doesn't ) . So just keep paying what choice do you have? Don't let them steal your house... Good luck.

After getting behind in my mortgage because of illness with my autistic son and his father's lack of willingness to pay child support, I have been working with ASC (who bought my loan without me knowing) to repay the amount. When they finally got around to doing a modification on the loan they told me I had 4 days to come up with $3000.00 as a down payment. I explained that if I had that kind of money readily handy I wouldn't have to do a modification of the loan.

So for the past 3 months, we've gone round and round with them. I've tried sending them money via western union (online) which their website states they accept. Guess what? Western Union says NOPE they don't accept it. I've tried sending them checks they send them back. I've tried using a check by phone and credit card to pay them, they said they won't accept it. They will only accept western union at an actual store (which by the way ONLY takes cash). So this Friday, I tried sending the money using a card (that is attached to my bank account) to send western union from the store and that is when I found out they only take cash. Of course, Friday night no banks are open. I called the representative 5 times over the course of 6 hours (NO RETURN CALL), I called customer service (NO HELP THERE) but they can't do anything because it's in a modification... Of course I only get told this after I had held on the phone for a total of 1 hour and 47 minutes (I WASN'T HANGING UP until I talked to someone).

So here we are on Monday, I call the rep AGAIN times 4. She FINALLY calls me back at 3 p.m. and says she can't guarantee that the modification will still be effective and I have to wait 24 hours until I can find out. If not, GET THIS... THEY ARE GOING TO SEND MY MONEY BACK TO ME!

What's up with a mortgage company that won't take payments? Are they just looking to foreclose or what?

I HATE THIS COMPANY! They've ruined my credit, they won't work out anything with me, and I'm stuck! Anyone with any advise?

I originally refinanced my home with Fremont and then my loan landed in the hands of the infamous America's Servicing Company. I am a realtor and when the market began to decline I asked to have a pre-payment penalty waived so that I can access my home equity. At that particular time all of my equity would have been swallowed by the pre-pay. They refused. I then fell behind on my mortgage. To try to contact them to do a work out is USELESS! They offered me a loan modification and asked for some documentation. I faxed them daily for a whole month and they never received them. Each time I called them after faxing they told me not to check back for 3 days. I finally express mailed them and they never landed on the desk of the processor until 10 days before the sale date. I had to file BK to stop the sale. When I called the trustee to advise them, the rep at the trustee told me that she was not surprised because ASC is notorious for this type of behavior. While in BK I attempted to do a workout under BK protection. I was not told until after the BK discharge that there was someone all along in a specific department that could handle this. During the BK I was only told that none could handle the loan mod. I had to file a chapter 13 now just to keep them from taking my house. None can talk to me to clear this up. I have been working at trying to communicate with them to resolve this for over a year and have only been successful under BK protection. I just tried to fax communication to the BK department to attempt a loan modification during the chapter 13, and guess what, I was given the wrong fax number.

You would have fallen behind with out an illness or child support. You were notified by mail 30 days before your first bill was due to ASC by both your original lender and ASC because of federal law. Nobody has to ask your permission to buy that loan, get over it. That "modification" is called forbearance, they are working with you, they do not want to foreclose because they will lose a great deal of money when that happens.

ASC is not accepting your "attempted" payments because you are most likely being foreclosed, and if you read your mail you most likely already have been notified. The company did not ruin your credit, you did that. Instead of ranting on a website hoping to find some one that has sympathy for you get a lawyer and work on saving what you have left.

They have done this to me also... except we call the payment in get a confirmation number. I misplaced the confirmation numbers and they charged me 5 late fees which I cannot prove I paid in time. I wrote a formal letter to the company requesting a investigation into this since I was issued a confirmation number and they conveniently do not show these. They are claiming the late fees will stand and my request to have them reversed is denied. This is a huge problem since I have a $250.00 PMI that I am paying every month. I do believe they are rip off artists and I am trying to refinance my loan to get away from this lender. Asta la vista ASC.

My house goes on the auction block 6 days from now. I have spent the past 4 months trying to work things out with ACS. I was getting nowhere - the same stories you all have - no contact phone numbers, endless holds and we will call you back, lost paperwork and all the time strung along with promises. I lost me legs - both of them - had prostheses and then got in a car accident and lost even the fake legs! I am on Disability and I have owned my home for 10 years. Recently it cost me to modify it for an electric wheelchair. I have two children and a husband who has recently become ill and can't work, has no medical insurance and is waiting to get on Disability. I can still have enough of an income if they would add the outstanding payments to the back of the loan and modify the payment as they led me to believe they could. When I read Eric Lopez's comments, the collection agent for ASC, I just broke down and cried. I just found this website tonight. I was hoping that this week I would manage to find someone there to talk to. I even paid a website $10 to get a list of phone numbers for ASC (they are supposed to be verified). Nobody should have to pay for a way to call their own mortgage company. If you e-mail me I will give you the numbers. But after reading this board I have lost all hope. There is currently a big settlement through the Attorney General with Ameriquest Mortgage and I thought they weren't half as bad as ASC! I am going to take all the information on this board and all my own information and go to my State's Attorney General. Will you all do the same. You can e-mail me directly if you want. I am not taking this - this is America - and we the people will be heard. I am an investigative journalist and I am going to use the power of public opinion. If Wells Fargo, who is ASC, does not want to be dragged through the dirt - big bad corporation against the little man - then things will be done. But one way or the other ASC is going down!

My mortgage was just bought by this company. I have had a hard time dealing with them. I tried to call customer service to get my loan number corrected because when I tried to sign up online it said I had the wrong loan number, they just said that they couldn't help me. Now how am I suppose to pay a bill when the loan number is wrong, and they can't correct it. I think they are run out of Nigeria and are just stealing our money.

My home was destroyed by a fire in June 2017. I received a check for the home from the insurance company. The check was not enough to cover the entire loan amount. I called ASC to see about sending them this check and when I sell the land paying off the rest of the loan. I was told to sign the check and send it to them and they would put it into an escrow account until I could pay off the loan in its entirety. I questioned this (because I know that escrow accounts are interest bearing accounts) I was told that this is their"policy" I don't understand why they cannot apply this amount to the loan leaving me with a much smaller balance. I suppose when it comes to big business they can eat us up and spit us out and have no feelings of regret for doing so. I was devastated after losing my home and now to have these ###s saying they will hold the check just pisses me off. Does anyone know who I can call to help me with this situation. I live in Florida and I am at a loss,really at a loss.

I think for now I will hold the check and send them the entire pay off amount when my land sells. Play hard with me and I will play hard back keeping them from gaining any more money in my name.

I HAVE MY PAYMENT SET UP FOR THE 28TH OF THIS MONTH, WHICH IS OBVIOUSLY LATE AND I WILL HAVE TO PAY THE HEFTY LATE FEE. THE PROBLEM IS THAT THEY STILL CALL ME 4-5 TIMES A DAY UNTIL THAT PAYMENT HAS POSTED ON THEIR END. WHAT I DON'T GET IS THEY SEE MY PAYMENT ON FILE WITH THE CHECK I GAVE THEM, BUT THEY STILL CALL ME. DO THEY THINK CALLING ME I AM GOING TO PAY IT SOONER, NO, THAT IS WHY I SET IT UP FOR THE END OF THE MONTH. I CONTACT THE BBB AND WILL CONTACT THE AG NEXT. TOMORROW I WILL BE SENDING MY CEASE LETTER TO THEM, BUT THE SINCE THEY ARE NOT THIRD PARTY COLLECTIONS, I AM NOT SURE ANYTHING APPLIES TO THEM. THEY DO NOT HAVE TO ADHEAR TO THE FDCPA. SO I AM NOT SURE WHAT THIS WILL ACOMPLISH.

With so many complaints against this company, why has there not been anything done about the situations. I think by now something should have been done to address these complaints, who do the people turn to for help? Why report complaints if we can't get a good outcome. These problems need to be addressed in a timely fashion.

I agree. They harassed me and my husband for months about a payment that they lost and had posted to another account. It took over three months. They even threatened to foreclose on our home. Part of the mortgage goes to them and the other to another company. We 've got the letters to prove their harassment, phone calls, etc. They should be sued.

Their service are just poor you can nevrer get a straight answer about anything. The rates are just to high and if you try to work with them on getting problems fixed or taking care of you can never get in touch with the people you need and they rarely return your calls.

My mortgage was purchased by this company shortly after we got our loan. I think maybe within 3 months ASC bought it. We hadn't had any trouble with them until our taxes became overdue. They sent me a letter saying basically that I needed to send proof the taxes had been paid, or call their 800 number and talk to someone about setting up an escrow account for them. Well I made the call, and they told me how much it would boost my payment (doubled), and was informed that even if I didn't authorize it, they would pay my property tax and start an escrow account anyway.
Then, Jan 1 2017 came and went. I had some personal problems, and honestly could not remember if I'd mailed my payment. I remember writing the check, putting it in the envelope, and stamping it. I just don't remember if I mailed it. Well when I got the next statement, it showed that I owed for Jan and Feb. I said well ok, I must not have mailed that, my mistake, and sent in the full amount owed, plus the late fee. Today, Feb. 11, 2017, I got another letter shouting at me that my mortgage was in arrears and I was in danger of foreclosure! Immediately I called the number on the letter, and had a bit of trouble with the automated system. it hung up on me. So I called back, talked to a Rep, and was informed that they had not received either of my payments, and that I would either need to do a check by phone, or pay via the internet. Both of these charge you extra handling. The 'net now charges you $15, and the check by phone, $20. When I asked what would happen if my checks were found, I was informed that they WOULD be cashed and applied to my account, and I was advised to place a "stop payment" on the check I wrote.
I have thought about this for quite a while now, and I think that if the Post Office had lost the mail, my return address was visible in the envelope, it should have been returned to me. The checks have NOT cleared my bank, so no unscrupulous beings have grabbed it for their own criminal purposes. This leaves 2 options. The first: that I never sent a payment (my checkbook says differently, I have 2 missing checks in my statement sequence - and ONLY the 2 that were writtten to ASC). The second: ASC has misplaced the checks for purposes known only to them.
If you see a third option I would be glad to hear from you.
What I see is ASC needing to garner more money from payments. This means charging you to make a payment. Since they can't charge you for a paper check that you write out and send in, they need to "misplace" those payments. Not only can they charge you a late fee for not having your payment in on time, they can charge you a service fee for using their "fast service" payment options.
I certainly hope that I am wrong, but from other things I've read about ASC, I don't think I'm far off the mark here.

Hi, soo soorrrrrrry most of you are in the same position my husband an I are. It has only just begun... everytime you are over 30 days they will continue to add the $15.00 inspection fee plus late charges... They willl also use your mortgage payment to pay the insurance first, then say your missing payments when in fact your not. I have been told they can hold moneys to pay for insurance for up to 3 years in advance.. We did not chose this company, but yet we have them an we need to stop Wells Fargo from getting away with this... By the way I have tried to find the Insurance Company, an all i get is ASC. when asked the name i have gotten 3 names so far an 3 different addresses... Good Luck...an stay in touch.

Well HOWARD... I am an educated person who has owned three homes I can tell you your full of crap in the biggest way, I have never had problems with any other lender than I have with these ppl and I am not a subprime loan thank you very much! you need to take a hard look at the practices of this particular company and telling ppl that they are modifiing their loan and then they don't, companys are under no obligation to modify a loan but HOWARD if they agree to do it then it should be done period not the runaround and legitimate companys do not do this to ppl I could go on about other issues. I say either a company has programs in place to help ppl and ppl are told about these programs instead of hiding them or they do not offer such help and just forclose you see HOWARD it is the falsely leading ppl to believe they are going to help them and then not and usually by the time these ppl get an answer its to late to sell or have options. I know HOWARD in your world it would be smarter for ppl to just make their payments on time but reality is that things come up God forbid it should happen to you and your judgmental ways... what goes around HOWARD always comes back around ...

Read your loan documents in the Deed section it gives them the right for a property inspection and you to be charged... should have read that before signing...also your payment is due on the 1st not the 16th that is a grace period saying that they won't charge a late fee until then. The LEGAL due date is the 1st. Again read the NOTE in your loan documents.. guess you did not read that either before signing... Just because you fell on hardship does not mean that this or any other company can give you a workout plan that suits you... they have guidelines they have to follow. This is not a loan to loan basis otherwise all of you would be crying discrimination

So, here’s my sad tale about ASC. I wanted to help my son buy a house in March 2017. His credit was poor so the mortgage broker suggested that I get a 2 year arm with a 2 year prepayment penalty mortgage AND after the 2 years get the loan refinanced in my son’s name. Good idea… So early 2017 comes around and the mortgage guy calls telling me that we need to start the process of refinancing in my son’s name. We start the paperwork and when the guy gets the payoff amount, he finds that there is an additional year prepayment penalty! Yes, I signed that at closing even though it was not the loan we discussed. Of course the original mortgage company is out of business but we track down the manager of the funding company (also out of business) and he says that the loan was definitely supposed to have been a 2 yr arm w/ a 2 yr prepayment penalty - not a 3 yr prepayment penalty. So I started calling ASC and they offered absolutely no help - telling me that I signed the paperwork and tough luck. Back to the manager of the funding company, he gets copies of all the closing documents including his handwritten notes to the mortgage company confirming the 2yr/2yr - he sends that to ASC and they still say tough luck. The payment has gone up by almost $600 per month and the kid can’t afford anymore money so Mom (me) gets to pay the extra plus all the taxes and insurance. I can not afford the extra expense - if the creeps at ASC would just refinance the loan to a 30 year at current rates, my son could afford it and ASC could keep the loan. As it is, we are considering letting the house go back to the mortgage company. So many big banks getting bailed out and all I’m asking for is to have a good loan refinanced at current interest rates - without a prepayment penalty of $18, 000.00.

You are correct in your statement. They have the audacity to say that their merchant service provider charges them to make the payment online and in turn they have to charge us. Well, I know a few people in that business and the charges are about $.20 cents per transaction in the high side or $.05 cents per transaction. So, ASC charges $10 to make an online payment making money off people who are having a hard time making their monthly payments...THEY ARE A BUNCH OF CROOKS AND SHOULD BE INVESTIGATED BY THE FBI FOR MONEY FRAUD!

Yes, even the supervisors are not personable. I asked to speak to a supervisor because I was receiving inconsistent information and both times, they were very evasive. Also, they were protective of their own employees. The information I received from the supervisor was inaccurate. The supervisor also basically suggested I was lucky I got to talk to her and acted like it was a burden to resolve the unresolved issue.

I totally agree with you. AHMSI is not a mortgage company and they don' t have to follow the same rules that a lender does and they make this very clear in a very rude and disrespectful way. They are a servicing company for the investors, whomever they are. Anyway, I called to try to get a loan modification. My interest rate is 7.75% interest only for 5 years. After I fax over all my paperwork, the woman has the nerve to tell me that they can get me in a fixed interest rate of 8% and my payment would increase by $500. Well if I can't afford the payments now, how can I afford $1900? I hate this company and I hope they go under.

I was having truoble logging in to my account to make a mortgage payment. WhenI did get into the account and re-entered all my banking infomation, routing number, account number amount of payment. When promted to continue the information was wrong as related to the amount of payment. This did not reflect what I entered. My payment was about $1800.00 but the information on the screen was over $13, 000.00. I tried to correct it but the screen went blank. I called ASC and tried to correct the mistake. The person assisting me informed me that I was being recorded. When I informed her that I was recording the conversation she said that was illegal and hung up. I am concerned that ASC may attempt to withdraw this money from my account. Still have got it corrected.

ASC epitomizes everything that created the current economic chaos. If that weren't enough. they are now the brick wall standing in the way of any sort of recovery, repair or improvement of the system. The fact that they would charge me $20 to pay the bill on the internet is outrageous. As a protest, I make sure that they get the payment at the latest possible time of the 16 day grace period. I think everyone should. A 16 day float on funds multiplied by say 100 people is a major hit. DO IT! It is the only way to hurt them!

ASC are the biggest crooks in the housing industry. They are also the least visual aspect of the industry. If you want action here is what i am going to do and you must do. By pass ASC, that's right, do not talk to them again. Send all your payments by certified registered mail signature needed so you have a record of them accepting them before the due date. Then go directly to Wells Fargo themselves. They are very visible and unlike ASC, have a image that they do not want tarnished. I am a Realtor in Oregon. The first thing I am going to do is send an e-mail to all the real estate agents in the state asking them to go to this site and review the complaints against ASC and against Wells Fargo since they are the parent company and remind them that if their clients take out a lown because of the agents recomendations or even on their own accord, the clients rath may reach the agent in the form of no referals and no repeat business. This I will also send to Wells Fargo so as to make sure they know that their image is being tarnished. Next, I am going to spend at least 4-6 hours a week in front of various Wells Fargo banking locations talking to their customers and asking them to review this website. Let's see how the rats will react when someone actually turns the light on them.
