bad ethics
For three months we have been working with Bank of America to purchase a short-sale being held by Countrywide now Bank of America. We are the persons who had an offer on the condo unit in Los Angeles area
We made an offer the end of March 2009 on the property.
On April 10, 2009 Our real estate agent received first verbal verification that our offer had been accepted from Bank of America real estate agent Maggie . We were told the written acceptance would soon follow.
April 21, 2009 our agent reported that she had received an e-mail from Maggie stating she hasn't heard yet and has been calling them 2 to 3 times a day. She said the supervisor was on vacation but is back now and we would have the papers in a few days.
April 25th, 2009 our agent reported that Maggie called the supervisor last week (Wednesday) and explained that the negotiator had told her she was faxing the approval and it never came and that the negotiator isn't returning her calls. She spoke with a supervisor who said she would look into the file and talk to the negotiator. Said to expect a return call in about 48 hours - meaning Friday or Monday). Maggie promised me she would call the supervisor again on Monday for an update.
April 28, , 2009 When our written acceptance had not come Maggie reported to our agent that she found out Bank of America has closed the file when she called to change her fax number. Apparently what they did was put on the notes that the buyer had cancelled the offer. (WHICH WE NEVER DID) The supervisor of Bank of America was able to fix the problem so we should be getting all the paper work by Tuesday of next week. Tuesday came and went.
May 13, 2009 Maggie reported to Our Real Estate agent that she has verbal approval from the supervisor but doesn't have it in writing yet. Maggie told Our Real Estate agent she would send our agent Our Real Estate agent a counter offer changing the escrow and title companies to the one that the bank was request. Maggie told Our Real Estate agent escrow is being opened and that we could do the home inspection.
May 21, 2009 Maggie has electricity turned on for inspection.
May 29, 2009 Inspection is back. We are still waiting for paperwork that is still not coming though we have been assured repeatedly it is on its way. Our Real Estate agent has put calls in for Maggie to see if she has talked to the supervisor recently. Maggie had said the supervisor told her she would have the approval out the first of this week.
June 3, 2009 Maggie reports that paperwork is being reviewed and can be expected soon.
June 8th escrow emails Our Real Estate agent that escrow is being opened.
June 9, 2009 Maggie reports the Our Real Estate agent that papers are still not ready and she is to follow up with them on Friday.
One June 15, 2009 We find out that the reason the paperwork is held up is because the lender made a mistake in the spelling of the buyers name.
Maggie writes our agent:
Sent: 6/15/2009 9:44:26 A.M. Pacific Daylight Time
Subj: Re: 11124 Burbank Blvd 104
Our Real Estate agent, the lender still is gone take about 2 weeks before they send the documents, since they had the wrong buyer's name on them they have to changed everything even do it was their mistake their process takes about 3-4 weeks to correct them. Please let me know if your buyer is willing to wait. I know it is very frustrating but there is not much that can be done but wait. Talk to your client and explain the situation and if she is willing to wait then we continue with the file if not
We told our agent that we are ready to purchase the property. We would wait for the corrected paperwork.
June 18, 2009 our paperwork moves from phase 1 to phase 2 negotiator. According to your own personnel, as of June 18, 2009, Bank of America had definitely accepted our offer and it was being finalized.
June 19, 2009 Our RE agent receives an e-mail from who reports that she just had a long e-mail conversation with the supervisor at Bank of America. They reviewed everything and don't find anything missing. According to the supervisor, they should be wrapping this up soon . Enclosed in her email was partial correspondence from Bank of America phase 1 negotiator Christopher Tata, who writes to Maggie:
Don't need anything else. And tell the buyer, to hold her horses, she is getting a property at a good deal, and these short sales take time. If she wanted a "Speedy" transaction, she could have bought new!
Note: Not sure what prompted this remark but it was made.
June 24, 2009 still waiting for the documentation that had been promised repeatedly, it was with complete shock after three months of your commitment that our offer was accepted, this is what we receive by email: In a message dated 6/25/2009 9:16:41 A.M. Pacific Daylight Time, MAGVES writes:
Hello,
the lender has accepted an offer with no loan or appraisal contingency and the buyer to make up the difference if appraisal comes in lower than the sales price. And the offer is not from our office. Thank you for your offer and I will be keeping yours on file.
Warm Regards,
Maggie Escareno
That was it after three months of being told our offer was accepted and paperwork would soon be coming.
If we are going to get out of the mess our country is in, we need to practice good ethics.
We need to believe in our word and the word of others. A short sale is no reason for bad ethics. We need to believe in the ethics of Business again. It was bad ethics that got us into this mess we find ourselves in today. Only good ethics can reverse that.
We expected Bank of America operate ethically and honor the word of their representatives. Were we wrong?

scam
This is the group defrauding people:
Bentley Travel, Five Points Travel, Dreamworks Vacations International, and Dream Vacations International present the travel club service which has been sued by NJ state Attorney General for fraud.
http://www.nj.gov/oag/newsreleases09/pr20090611a.html
Bank of America is the financial partner of this fraud. They allow these companies to open new credit card accounts from their victims and then refuse to refund the money.
Band of America even threatens the victims with the negative credit report, if they decide not to pay the membership fee, which has been proved that is worth nothing.
If you are a victim of this fraud, please do file your complaint against Bank of America with New Jersey Division of Consumer Affairs.
Bank of America has NOT been very responsive to complaints about Bentley Travel/Dreamworks Vacation/Daryl T. Turner. The Bank now is saying it is up to Master Card and their ( Master Card ) agreement, even though the NJ Division of Consumer Affairs has a judgment against Bentley Travel/Dreamworks Vacation/Daryl T. Turner.
Bentley Travel also did not have the authorization of open credit cards in the state of NJ thru Bank of America.
Thank you.
I did no sing up for this protection service
I open a, account with bank of america and put $20.00 in the account. I sent $15.00 out of my account with my atm card, it is showing that on my account. Then I looked at my account on-line and I had all of these overdraft fee's, for a program the bank said I singed up which I haven't. This protection program I didn't sign up for cost $38.98 which wasn't in my account at the time. The bank charged me for the program and also started charging me overdraft fee's of $35.00 each almost as much as the program, I have 3 overdraft fee's of 35.00 for the same product I didn't order. Then I apply for a payday loan and the bank took the money and payed the overdraft fee's with it, which have my account at 0.00 I need help.

I got a telemarketer call from Privacy Assist and was told they wanted to send me the information about the credit card protection program. I told them I do not want to buy that service. The telemarketer assured me there would not be any charges unless I sign up by returning the materials. I said OK, send it on.
Two months later there is a surprise 7.99 charge on the VISA statement to privacy assist. I called PA and was told they could only credit one month and that there was a pending charge for the current month. I did call BOA Visa and they will credit me both months. Gee, that took 45 minutes of my life to do. How frustrating. I wish I had a recording of the original call. That was clearly illegal to sign me up for a service I clearly stated that I do not want. Next time, I will stop trying to be polite and just HANG UP.
zero liability fraud protection
Our bank of america credit card number had to be changed about the first week of January 2009. He carries his card in his wallet and has not lost it. I had my card in my desk at home. We do not receive paper statements. So how did someone get the account number and try to book airline tickets?
I noticed the pending charge on 6/15 and called bank of america right away. They connected me to NWA since they (bank of america) couldn't do anything about a pending charge. I had to email NWA that I didn't authorize the passenger and they suspended the customer's ticket, BUT said I'd have to contest the charge with my credit card company (WHAT?). On 6/16, there was another pending charge, so I again contacted NWA and bank of america. NWA did not get back to me for 4 hours and allowed the passenger to fly (different name). I also contacted bank of america around 7am to cancel the card and reissue another new number.
Bank of America assured me that the 2 charges (over $600) would be off the account by the end of the next business day. Well, that didn't happen. I waited a couple days and called again. They "weren't sure" why the charges weren't removed, but assured me they would issue a credit and the charges would be off by Wednesday. Today is Wednesday and the charges are still there.
They keep trying to sell a service where you pay them to monitor your account. "Coincidentally" they called about it a few days before the fraudulent charges appeared AND the same day as the first charge appeared about two different programs (both of the programs we had already declined to be enrolled in within the last 6 months).
The card is a Platinum Plus with Zero Liability Fraud Protection that does NOT require enrollment in any programs. Why don't they just do their job? Now I have to call the fraud department AGAIN, but they aren't open until 8AM...

overdraft fee complete fraud
Bank of America is a complete rip off! They charged me $70 dollars in overdraft fees because my account was overdraft twice for a total of -$98.24. This was probably the second time I have ever gotten overdraft since I opened the account 8 years ago. I think the first time they charged me $5 for the overdraft and I didn't mind paying it. But to charge $70 dollars? That makes completely no sense at all. I mean all I did was barrow less then $100 for a week and get slammed with a $70 fee! I could probably barrow $9000+ for 21 days using a credit card and pay less than $70 in interest. Never bank at Bank of America. They're a complete rip off!

Bank of America was bailed out with Federal Funds that you the taxpayer are paying for, and now when I told them to close my account, some six months later, I get a letter from a collection agency for $57.64 in overdraft fees. which I haven't used, because I had a zero balance.
They were supposed to close out the account in January, 2010, but as usual, BOA puts their head in the sand or hands on their ears and eyes and keeps charging me for an account that I closed.
Somebody in congress ought to deal with this bank, as they don't mind robbing from the poor and keeping you poor.
privacy assist scam
**don"t bank with bank of america!!!** I am writing this to inform everyone - don't bank with boa! I am on my elderly father's accounts and recently I was checking something in the account when I came across $12.99 debit that stated "privacy assist bank of america". I found this odd so I researched the past statements and found that it started in march 2009...

I agree. A friend I know received a loan mod from them. He and his wife were quoted a price to pay each month for three months as a trial basis. At the end of three months they payed early and promptly and called to find out what would happen next. They were told they overpaid monthly by $600.00 dollars and the plan had been changed! Well they were happy the payment was lower then what they paid. It seems the Hop foundation was on a conference call with them and heard BOA quote this price and deal. Imagine how these people felt when they were told it was changed and they did not abide by the new changes that no one notified them of ! Now they were disqualified! I have asked them to call an attorney so they could actually sue BOA. How do you agree and then change it without sending written notice return receipt? BOA took money for bailouts to help the consumer and yet less than 7% of their default customers have been helped! Return the bail out funds and allow some agency to help people such as these. Project Hope would be the ideal candidate. Let BOA go to the dogs and the CEO work at Burger King!
credit card fee scam
In February 2009, I paid my card payment online before noon on its due date, only to learn that the Monday due date was a holiday. Being disabled and unable to work, I hadn't realized that the day was a bank holiday. I had missed one payment a few months before because I mislaid the bill. My fault. I paid the late charge. But missing two payments jacked my interest rate up to almost 20%. Upon checking, I realized that since May 2008, five of the total 13 payment due dates were on days when the bank was closed. If the library in my town can program their computer to schedule book due dates only on days when they are open, why can't Bank of America do the same? I would love to get in on a class action law suit to bring attention to this consumer scam.
The complaint has been investigated and resolved to the customer’s satisfaction.
So invalids don't know when there's a holiday?
Here's a tip, quit waiting 'til the last minute to pay your bills, you inattentive dolt.
Your disability shouldn't be used as an excuse. It makes it look like you are fishing for pity.
You sound pretty functional to me. How does it prevent you from paying a bill on time?

I am a bofa acct holder went to the bank cashed my check and did a deposit w my landlord business deposit card. I do this every month and there is never a problem. I consolidated credit cards with Bank of America at 2.9% a year later that rate jumped to 9.9% and today they called and offered to reduce it to 6.6% if I payed them $800. When they called however, the called under the name of Credit Card Services a consumer help agency... I was told that I could reduce my interest rate from 9.9% to 6.9% for no cost, I was all for it. When I receivd the call back from MR. Paul Blake, after I questioned him to ensure that there were no additional fees, eg; application, transfer or other he said no, no fees. I then told him ok lets do it and then he told me, " There is an $800 charge! I asked him why and he said, " that is just the way it is" I was shocked at such an answer and immediately didn't trust this deal, I asked him who was doing this and he told me Bank of America. IT was then that I realized that the bank I had been dealing with was now offering me a reduction in interest rate if I paid them. This seems cruel, it also seems like bait and switch, the callers never identified themselves as Bank of America employees, just as employees of a company that was workingto reduce credit card debt for over paying consumers.
HELP
deceptive trade practices - stealing from customers
Bank of America has been charging me NSF fees when my account is in the positive. I spent hours researching exactly how they were doing this and finally uncovered it. They are very sneaky!
Especially if you use online banking I suggest you start printing out your available balance page every day. Maybe even twice a day. How can you be charged a $35.00 NSF fee for a 26.95 transaction when your available balance before the 26.95 charge was 568.20? Then your balance was$541.25. The next day you deposit 2, 500.00 and are charged two NSF fees for activity they state for the prior day. It doesn't make sense to me! This happened on June 4th and 5th. The 26.95 was charged on 6-4-09 and my ending balance was $541.25. The $2, 500.00 was deposited the morning of June 5th showing my new balance as $3, 041.25. That day I had a $600.00 charge clear my account ( the 5th ). This charge was authorized on the 3rd and the funds put on hold in my account; however, the hold was released on the 4th and the funds were taken off hold and returned to my available balance. The bank is saying that it was this pending charge that caused me to go into the negative. Online banking though showed this charge pending and my available balance after it would clear and I always had a positive balance. They do not make any sense and what they are doing is criminal in my opinion!

gave out personal information
A Bank of America employee gave my stalker my checking account number, and also told him how many accounts I have with B of A. My stalker was able to walk into a local branch and make a deposit (using bad checks) into my savings and my checking, and then went to another branch and made a deposit into my savings (also a bad check). This is especially frustrating because four days prior I had called B of A customer service and had a notation put on my acct stating that "No transaction be made without two forms of ID." When I spoke to the branch manager, I asked if "transaction" meant withdrawl. He said, "No, a transaction is a a withdrawl, deposit, or transfer, " yet couldn't explain why a grown man was able to make a transaction using my account without showing two forms of ID - since he is obviously NOT a twenty five year old woman, as I am. The manager did agree with me that no one should be able to access information such as account numbers, or even how many accounts a customer has. But he had no explanation and no remorse for the fact that one of his employees had divulged that exact information.
I can't trust Bank of America now, knowing that anyone can walk into a branch or call up and get my personal banking information. What's next? Getting my money?

they put my money into wrong account
On 5/26/09 I put $1500 into my account to pay my bills. A week or so later I go to the bank to put more money in for the next batch of bills - only to find that the $1500 did not go into my account - they told me I was over $400 overdrawn. After investigation at my main bank, it was discovered that the $1500 was put into another account, not mine, therefore, I had checks returned and my health insurance was cut off, since they sent their check back - I haven't received it as yet. When I called my insurance they wanted a credit card over the phone, I do not have a credit card, so they said it will be cut off, I am waiting for the letter. I do not know what I will do without health insurance.
Bank of America did not care, they were rude, I was given someone else's information, they were patronizing beyond belief. These are people who HAVE jobs, people who have jobs because our President gave our taxes to the banks (and our children's taxes and possibly our grandchildren), which was terribly unfair.
Now, in the middle of having physical therapy, I have no health insurance. All BANK OF AMERICA'S FAULT! I have no job. I have no savings. BANK OF AMERICA added insult to injury by offering me a GIFT CERTIFICATE as compensation, first they offered $50 and then $100 - what a massive insult - since they have ruined my life.
Everyone I spoke to about this at BANK OF AMERICA were not bothered, I AM!
I want compensation!

You should have gotten a statement, and you should have verified the balance of your account. I know that I NEVER leave my bills to chance.
BofA put one of my deposits into the wrong account as well, but refused to fess up to their error. I was eventually able to get them to reverse the fees that were charged by the subsequent overdrafts (because I had proof that I had actually made the deposit for the correct account), but they refused to acknowledge wrong doing, and continued to insist that it was an error that would have been impossible for them to have made.
They are complete crooks, and we are leaving them this month. Not merely over the above, but also due to their continued tinkering with transaction dates and times that ends up causing numerous headaches for us in their attempt to squeeze out more overdraft fees. I would have failed highschool business class if the teacher had caught me switching up transactions in the bank ledger as often as these guys get away with doing.
would not honor credit for purchases
I shopped from many qualifying stores from Bank of America ADD IT UP program and still have not received any promised cash back. My purchases were mostly made back in December 2008, and its already June 09, and still nothing! I called numerous times to the customer care and they all keep on telling me they will "investigate" but nothing happens. The most annoying part is that they have the nerve to tell me that I did not go through their site to purchase because there were no CLICKS. How can they tell me that when I ALWAYS go to the store websites through their ADD IT UP site? The most annoying part is that you can't prove them wrong. Their customer care reps are friendly, but useless. I won't even bother using them anymore.
I am a very loyal Bank of America client and share holder. I have been thoroughly unimpressed with the Bank of America Add It Up Program. I signed in through their website and made qualifying purchases and did not see the credit come through automatically.
After repeated calls, I was assured that technical support and a supervisor would call me back. This never occurred. Most recently, I called back to get to a supervisor and was placed on hold. No answer. In fact, I was curious if there ever would be an answer so I left the call on hold. When I got back from work the next day, the call was still on hold. I got tired of being on hold 25 hours, tying up my phone line, so I finally hung up.
There is no excuse for this type of customer service (or lack thereof). I'd recommend that others take their business elsewhere.
The Add It Up program is a scam. They refuse to give you the cash back when you don't "click" or "redirect" through their website. The reason why I didn't purchase my airline tickets through redirecting was because they INFLATE the price when you do. You're either paying a higher price to get your "cash back, " or not getting a refund at all.
I recommend you take your business elsewhere. What they are doing is unethical and FRAUDULENT!
I'm on the same situation as you! I have been kept on limbo for 3 months.
Marie,
I am not familiar with the specific Bank of America program you are writing about, but there are a great number of pending class action lawsuits against BofA. Check out my site at www.classadvocate.com. Click on the defendant box then look for Bank of America. One of those law firms may be of help. Good luck.
subversive data collection
B of A (Bank of America) utilizes data gathering techniques beyond information provided on checking, savings and cd accounts to develop security clearance questions. For a bank to use covert data gathering information which goes beyond information provided in the course of doing business is appalling and truly an invasion of privacy. Simple questions regarding mother's maiden name, etc are expected. But, to ask questions regarding additional family members who have had nothing to do with the account, including their current addresses, ages, martial status, etc are extremely subversive and indicative of a lack of respect for their customers. I will never do business with this company again and find their actions to be unconscionable and a true invasive action. This type of information is not critical but to use data gathering to the level shows intent to profile clients and use this information in a variety of methods not normally seen in day to day business interaction. I have no credit cards, credit lines or loans with this company and now I will have nothing to do with them going forward. Their explanations were marginal at best and they state the information was gathered through public sources. I left Wells Fargo fifteen years ago and now I am adding Bank of America to my Black List of vendors to never do business with.

does not apply promotional rates to credit card balance transfers
BOA offered a credit card balance transfer at 0.99% to March 2010 (one year from filling out the online forms). After the transfer took place, they denied any promotional offer and are now charging me 22.99% interest! I am trying to get the finance charges for 2 months corrected so I can pay off the account, but after 2 days of calls I still get the run around.
DO NOT BANK WITH BOA. They are deceptive and do not honor their own offers.

FIA card services calls on my cell phone looking for somebody I never heard of. I tell them it's a wrong number. They call back 2 or 3 times a day. EVERY SINGLE TIME I tell them I'm not the guy and never heard of him. Obviously he gave a fake number. But they keep calling. 3 different times I get a "manager" on the line who guarantees they'll take the number out of the file. And a few days later they call back. But I can't just block the calls because it's from "UNKNOWN". No caller ID is presented in advance as far as I can tell. So I finally just said, yes, I'm the guy. I gave them BS information as I collected where they were, who I was talking to, how much I supposed owed... I think told them I wasn't' the guy, it was all ### and that now I finally knew where they were calling from (Kansas) and who they were and what bank hired them. I asked to speak to a manager again and threatened filing a complaint with the state board and whoever else I can find. That was today. We'll see if they call back tomorrow again. I feel like I'm in Ground Hound Day.
if it's from FIA, its probably about a credit card account you have. they are a credit card company, not a collection agency so call them and they can explain what accout they are trying to reach you about. it's possible your old acct # has been updated to a new acct # for security or other reasons, but they will look it up for you and probably can look up what charges you made on the acct and send you past statement copies too.
Call the number and find out what the issue is. If it is a valid debt make an arrangement to pay. Most account numbers on debt collector bills are internal account numbers, not the original account number from the creditor.
The advice given to not speak to them on the phone is not only irresponsible but also ridiculous.
You have the right to send a letter to them, tell them to validate this debt to you, and also tell them to cease and desist phoning you. You can sue them if they persist, and people do sue collection agencies and win, keep records of any calls they make to you and Very Important, do not talk to them on the phone anymore. You don't have to take it. Go to creditboards.com for more information and support.
Credit Reduction
I have enjoyed my relationship (as much as you can) with FIA Card Services (old MBNA). I have had a card with them for over 15 years. Yesterday I received a letter that my good history, with no overdrafts, payments on time, has been cut by 2/3rds. I contact the company to ask why this has been done. The customer rep, noted that due to limitations with the current banking industry that they are limiting their risk. I say this is ###! So I asked to talk a person in the credit department.
They transferred me. I explained my situation with to the credit rep. After talking a while, the credit rep informed me they cut my credit AGAIN! What the F**K! I asked to speak to a supervisor, and was put on hold and then was hung up on!
After being a loyal member with good history for years, I am being penalized for their mistakes. I plea with anyone thinking of opening a FIA Credit Card - DO NOT. PASS, it will be the biggest mistake of your life. The next time I call it will be a cancellation of my account!
The complaint has been investigated and resolved to the customer’s satisfaction.
They're doing that with all credit cards. This is ### !

Not only is Christopher a bad representative of the bank but he is also morally bankrupt because he slept with another man's wife when she had a 1 year old at home. He is a complete waste of a human being. He has personally cost the bank thousands of dollars with his misdeeds and I know that first hand. It's too bad you had to come across this creton's path.
I have had almost the exact thing happen to me - but we put our offer in on January 2009. It is now June 28. We were told at the end of May that the acceptance letter was ordered May 28. Hah!
My advice; don't get an inspection (like we did) until you have the letter from Bank of America in your hand. They do not keep their word and when they give you a date when something will be done don't believe them or get your hopes up. We have been in this misery for 5 months now!
