What we Countrywide-Bank of America victims have to do is band together, each of us, assemble a package of information (the hardship letter and a history of our dealings and results from Countrywide-Bank of America), create an email list from the President on down, and start emailing, demanding something besides lip service (from the President, Secretary of the Treasury, senators, representatives, Barney Frank, all federal regulatory agencies, state governors, senators, representatives, etc., etc.).
Getting on these blogs or discussion boards and complaining to each other is a waste of time. We need to put together an organization to serve and respond to our needs in effectively communicating with influential people, and we need some organization to facilitate this by, among other things, allowing people like me to share my email address with those interested so that we can communicate with each other rather than just writing our stories on a very limited “wall” where they are not seen by decision-makers. We can see, read, and sympathize with each other, but this is really a waste of time. Until we can communicate, organize, and initiate action, let’s face it, we might just as well give up, because no one cares, really, but us.
Despite what he says, President Obama has too much on his table to spend time on this. Unfortunately, he is mistakenly trusting the Secretary of the Treasury, Timothy Geithner, to manage this. Geithner’s not doing his job for the citizens of the United States whom he swore an oath to serve. Instead, Timothy Geithner serves the banks that he has always worked for—and whom he helped get us into this mess by not regulating at the NY Federal Reserve. And so, in his alleged plan to help people confronting foreclosure, he placed the administration of the program into the hands of the bankers and lenders who got us into this mess in the first place. He put the fox in charge of the chickens, and the chickens are slowly disappearing. I wonder why?
Neveretheless, we the victims have to band together to form organizations, email everyone from the President on down (the Secretary of the Treasury doesn’t have an email address. Surprised?), and make our voices heard. We also need a responsible website, such as this one, which will facilitate our communications so we can organize. Today I receved a call from bank of America from the card services dept . the representative was calling my cell phone requesting to talk to some body else, so I told him he had the wrong number, he got really upset and started asking me if I speak inglish and he was saying this is america, I felt desrespected and hang up, the same rep call me about 4 more times screaming "white power" I hang up again and decided to cantact a manager, after calling 5 times and explaining my situation both customer service reps and managers hang up on me several times, I called another departament and I a manager took my complaint.

I'm a white manand was recenlt in Bank of America's corporate center in Kennesaw, GA. Out of about 500 employees that I saw, 499 were black. I was treated very poorly for being a white man from the minute I walked in the door by the so called "security" people that looked like Kenyan malitia, and received dirty looks from every employee that I passed. If you are white, don't bother applying at Bank of America. They are a racist organization and will probably not hire you

I ended up paying almost $900 in overdraft fees for my checking account in a 4 month span. Their online banking that I was using to chen my balance was not updated quickly. Also, some transactions take forever to process a debit purchase and by the time it goes into my account I don't have money to cover it, although I did the day of purchase. I tried to get some of the $35 overdraft fees taken off and they said "there's nothing we can do." I was so upset! Were in a recession and you're taking money from me without me knowing it... I may as well give my money to a stranger to hold onto it for me! I couldn't even pay my rent that month because they took all my money! Bank of "America"? Not for this American! Beware! Will charge you $35 overdraft for a $1 overage! Bloodsuckers!

BofA has every right to charge overdraft fees. However, the fees should be proportionate(spelling)to the amount the account is overdrawn, or the transaction amount per fee. With that being said, I'm not the best at balancing my check book - but BofA has charged me over $860 in overdraft fees in 12 months. I added all the transactions that made the account overdrawn, and it came up to $78. That means they are charging me over 1000% of what they covered in fees.
Also, if they were really trying to be customer oriented, they would give you at least 24 hours to replace the funds (bring your account back to balance), before charging you a whopping $35 dollars for every single transaction.
The most frustrating fees I received just happened last week. I was overdrawn after the weekend (usually it's always on a monday when all the fees come in at one time) by $40, so I transferred $200 out of my primary account to my secondary account (the one I have issues with, becasue it's tied to my debit card), which made it +$150 and change. BofA charged me four overdraft fees that same evening for $140. Three new transactions came in for a whopping $27 dollars, which ended up making my account overdrawn (because the transaction fees were taken), so I had to pay $105 dollars more in fees for the items that were overdrawn because of the overdraft fees from the bank.
Now that is scandalous any way you look at it.
When my commission check hits this week for $13, 500 I'm going straight to the bank to close my accounts. I've been banking with BofA for 18 years, and ever since online banking came into factor, it's been a problem.
I'm surprised at how many attacks there are against those posting a complaint about the bank. If that many people are complaining about the same thing, then something is up. And I'm sorry, whether you like it or not, keeping purchases in limbo DOES throw things off. If for no other reason than when it DOES finally post it doesn't have the transaction date. There is NO REASON for transaction to remain pending. If the money is there then pay it RIGHT NOW [censored]! What are you waiting for. And I'll tell you this. Before computers started all this pending BS people were NOT getting overdrawn as often. It's clearly in the banks interest to keep it going because a hell of a lot of people find themselves confused over the state of their accounts, especially when transitioning into a new month. I'm sure the person to make the first comment about this complaint has Bank of America's heartfelt thanks. After all they do have to finish handing out all those executive bonuses before the new laws take effect in February and they need us little guys to help pay for it. They sure got a BIG chunk from me.

If you do this everyday you arent going to overspend, Banks of all kinds post those online, over the phone, what ever basically so you know what has CLEARED, it doesn't necessarly mean whats PENDING. If you dont know how to manage your money, take a class. Otherwise dont blame a bank for charging you for overdraft fees, THAT THEY TOLD YOU THEY WOULD IF YOU SHOULD OVERDRAFT YOUR ACCOUNT, its your fault not theirs. Yeah we are in a rescission and Bank of America has to protect themselves to. When you opened your account they let you know the terms, if you are really that concerned, get a freaking line of credit, but judging by your money management skills you admitted to, your credit probably sucks to bad for one of those.
LYING ABOUT MODIFICATIONS
We wanted to let everyone know that mortgage lenders are still deceiving the American people and the American government regarding loan modifications. We hear in the news everyday how the U.S. housing market is "bottoming out" or "finally stabilizing" or "sales are picking up". But the reality is that it is not. Not for homeowners whose lenders are corrupt, that is.
Please do not misunderstand. There are lenders who are doing their best to help homeowners and we are pleased they are now generally making a effort to work with homeowners and keep them in their homes. We applaud those lenders/banks. However, we wanted to bring to your attention a particular lender - Countrywide Financial (now operating as Bank Of America Home Loans).
We are sure you see comments all over the internet on how this lender is blatantly employing forestalling tactics to deceive the media, government, and the American public. In our opinion, this lender has absolutely no intention of complying with President Obama's American Recovery and Reinvestment Act of 2009 and has no intention of keeping homeowners in their homes. Countrywide Financial's website says they have a "commitment to supporting the Making Home Affordable program" but that is a lie. We have filed numerous complaints regarding Countrywide Financial for their refusal to grant us a loan modification on our home even though we meet the criteria.
The Superior Court of the State of California for the County of Los Angeles Northwest District issued a court order for Countrywide Financial to provide loan modifications (Case No. LC083076, California Attorney General and The People vs. Countrywide Financial). Though we were not part of this particular lawsuit, our situation still meets the criteria described in the settlement. Also, included in the settlement was for Countrywide Financial to furnish to the California Attorney General a list of account numbers of those loans which have been modified. I doubt, to this day, they have sent any tangible information to the attorney general.
Here's the deal:
1) Countrywide is NOT MODIFYING loans despite what they tell the government, the media and the American people.
2) Countrywide is violating court orders and is in contempt of court.
3) Countrywide received TARP funds and yet they openly refuse to abide by the mandatory Obama loan modification guidelines.
Bottomline: Countrywide Financial is STEALING our taxpayer bailout monies!
For those who are experiencing loan modification issues similar to our situation, please seek advice from an attorney AND DO NOT BE AFRAID TO LET GOVERNMENT OFFICIALS KNOW ABOUT YOUR LENDER REFUSING TO GRANT YOUR MODIFICATION (if you qualify for it). Write to your Congressman or Congresswoman, write Housing and Urban Development, your state's attorney general, your state's housing departments, your state's consumer affairs, your governor, the Better Business Bureau, the Federal Trade Commission, the Department of Real Estate, even write to the President of the United States, the Vice President of the United States, the Office of Public Liaison, write...write..write...or fax...fax...fax...or email..email...email..or call..call..call. I was denied a modification on Aug 31 but didn't find out till today Nov 3 by them slipping up.
I waited 3 months for this and i was denied and they didn't even send out a F you letter...

JAN: We saw your post. Yes, that's the LATEST AND GREATEST DECEPTION Countrywide/BofA Home Loans is pulling on everyone. Countrywide/BofA Home Loans is telling everyone -- the Attorney General, the media, the government -- that they "are doing loan modifications" but they have MISTITLED a Forebearance for a loan modification. What is a Forebearance? An agreement made between a mortgage lender and delinquent borrower in which the lender agrees not to exercise its legal right to foreclose on a mortgage and the borrower agrees to a mortgage plan that will, over a certain time period, bring the borrower current on his or her payments. A forbearance agreement is not a long-term solution for delinquent borrowers; it is designed for borrowers who have temporary financial problems caused by unforeseen problems such as temporary unemployment or health problems. What is a loan modification? Under President Obama's law (in a nutshell) it should 1) Be a lower monthly payment 2) Have a lower interest rate 3) Have a lower principle.
Countrywide will not release the raw "100, 000" loan modification agreements to the CA Attorney General because they are not at all loan mods and are not compliant with the LA Superior Court Nov 23 court order nor compliant with Countrywide's April 17 contract with the Dept of Treasury-Fannie Mae's whereby Countrywide agreed to modify notes at 31% as specified in the HASP-MHA guidelines. Ha! More delay tactics and deception!

My above complaint is that Country Wide has never helped me in trying to modify they just allowed me to pay my regular monthly payment of 2350.00 and add an additional amount to totaling 3250.00 per month for the next three months. That was crazy! If I can't pay the 2350 why would I afford 3250? They are now threathing me to foreclose and calling me every day and all hours including Sundays. Now Bank of America is doing the same. My attorney is taking care of this and they keep oin telling me that there is no modification in place.I don't know what to do! A lawyer is the best at least I hope so.
I have hired an attorney and have had her since February working in my morgage. There is so very much you need to do to even quilify for a modification. This is a long process and you need a lot of patience to go with it.Since then Countrywide is now Bank of America and I do believe this is not any better as Bank of America has faults and complaints on them also.I hope my morgage resolves soon . I did receive a letter from Countrywide telling me that I only have till June 7th to catch up with my morgage or they will start foreclosure on my home. My attorney is aware of this and telles me not to worry as I won't loose my home. I am trying so hard to believe this but lets face it this is very sceary! I was not behind when we walked into her office to being almost 6 months behind. Like I said this has been a long journey and it's not done as of yet!As I read these complaints from people telling us that they needed to be in foreclosure in order to quilify for modification I am learnig that maybe this is why my attorney let this go this long. ruthless overdraft charges
I have had an account With Bank of America, (before the two mergers as Bay Bank and Bank of Boston) for 17 years. I have had the odd overdraft charge because of my neglect yet i have have never complained or asked anything of them until today. Yesterday, my credit card payment was mysteriously taken from the WRONG account, an account i use for daily atm items. (coffee gas meals etc)
This mysterious ERROR caused, 7 OVERDRAFT CHARGES AT 35.00 EACH FOR A TOTAL OF 245.00 ! I called and said that the automated bill pay had switched accounts on me, they said call back tomorrow we will straighten it out. Well i called, they won't admit the mistake, and have credited me 60.00 lousy bucks. So they screw up and charge me 185.00 . These are ludicrous times. I am moving everything from bank of america... no more credit card, no more morgage, no more personal or business account. RUTHLESS

I verified routing number with bank of america associate for my federal tax refund direct deposit. Bank of america gave me the wrong routing number! I verified with the IRS the direct deposit for May 6, 2009 (they tried) BOA rejected it 1 day later I was overdraft fee bombarded by BOA ($175.00) Now I wait 6-8 weeks for a paper check for the $6, 000 tax refund. So I also will wait an extra 3 weeks for my sons to come to spend the summer with me in Texas. A bank BOA manager told me to take out a loan against my taxes. Pay the fees I said...no. Bank of America is heartless and ruthless...I suggest who ever reads this to close your account. Overdraft fees go to thier bonus funds!

refund of application fee
I applied for a refinance o0f my countrywide loan mid march and my loan agent then went on maternity leave.. referred me to her manager. I had numerous questions to ask about charges and loan rate changes. I had been not given complete or accurate information upon my initial sign up process. I eventually went to the loan processor Josephine Pagliarulo when my numerous e-mails and phone calls went unanswered for weeks. She initially tried to help but could not answer my questions or get me to someone who could help because of bureaucratic policy issues. I wanted to cancel my loan at that time and get a refund on my $485.00 fees charged. She became belligerent, unprofessional and accusatory- when I was the one with still no one being able to help me or understand that I had been told misinformation.. Very frustrating and I believe this woman should not be working for Countrywide as well because of her personal conduct. I asked her to just forget I ever called and will continue to work to reach a supervisor. She cancelled my loan and said the lock out period was over and I would have to start all over. I can not say how horribly violated I felt and just lost this money on my good faith of proper business practices. The government should shut this company down if customers do not just pull the plugs on it already.

ridiculous overdraft fee
I am outraged over the financial rape Bank of America is allower to get away with. On my checking account, I have several transactions pending. All funds were in the account before the transactions posted, but because technically/on paper, I was overdrawn. The charged me 2 - $35 fees. They never paid out any of their money in my regard. They used my money in my account. I bank with another bank and they do not charge a fee as long as all monies are in the account before the transaction actually posts.

The same thing happened to me. I called and complained and they returned a fraction of what they purloined as fees.
I filed complaints with the BBB and the Office of the comptroller of currency.
I doubt that will help but at least I'm doing something about it now.

Nonrefundable $400 Application Fee
On Mar 30, 2009 I spoke with a loan analyst (Corey Brown) and completed an application for a refinance over the phone. At the time of our phone application, it did not occur to me that a refinance loan with 1.5% points was not advisable for individuals looking to sell their homes within 12 months nor did the loan analyst articulate the % definition.
I simply was interested in consolidating our primary mortgage with a HELC. I immediately contacted Mr. Brown and requested that the loan be calculated without points. Once he did, it was determined that there was no financial incentive to refinance at this time. I was told at that time that the $400 application fee was non-refundable. I immediately cancelled the loan application but still got the charge applied to my credit card and received a large package of documents from Countrywide within 7 days of the phone application.
My concern is that if I cancelled the loan application process within 12 hours of the initial quote, where is the $400 charge being spent? I did not want any paperwork from them, there was no appraisal ordered, there was no out of pocket expense for them (other than the fedex charge to deliver unwanted papers.) This should be illegal!
On Apr 2, 2009 I submitted a request on the countrywide website under the messages > send comments section of our loan page. I have yet to hear back from anyone in customer service even though your website clearly states that inquiries will be addressed within 48 hours of receipt.

I have been trying to get a loan with Countrywide since January! I have decided to cancel the loan. I thought that because I paid the $400 application fee I would be able to get a copy of the appraisal. But, they say I have to pay another ~$380 for that. Is this right? Seems like a crock to me.

On 5/4/2009, I got a "partially Blocked Caller ID " from [protected] which left a message on my answering machine.
I called the number to find out and they started giving me the third degree and started telling me about their client, (Name Withheld) who owned them money and was past due 30 days. He said he worked for the Tennessee Office for Bank of America. I told him He was not with Bank of America because I just keyed in his telephone number on the Internet and he worked for a collections company, the one listed here.
He went on about some lady, and I told the guy that he couldn't disclose that information which is a violation of the Federal Privacy Act and that it was "Illegal" to block caller ID's.
I Quoted the Law and gave the jerk the URL which is at the Federal Trade Commission at:

The Law is The FCC’s telemarketing regulations under the TCPA also include provisions governing the transmission of Caller ID (47 C.F.R. § 64.1200).
It states., "If you have caller ID, a telemarketer it is required to transmit or display its phone number and, if available, its name or the name and phone number of the company for which it is selling products. The display must... include a phone number that you can call during regular business hours to ask that the company no longer call you.
This rule applies even if you have an EBR (existing business relationship) with the company, and even if you have not registered your home phone number(s) on the national Do-Not-Call list. Caller ID may Not include the words: “private, ” “out of area, ” or “unavailable” might have appeared on the Caller ID display, the Caller ID MUST be there now or its illegal!

He was telling the truth... I worked there before... FIA Card Services is the "Rename" for MBNA bank and Bank of America merged with MBNA Bank... shortly after the merge the Name MBNA was changed to FIA Card Services. Hope that helps. Collections are a different part in the TCPA, the Telephone Consumer Protection Act. Be sure to read up on that.
i found a wallet - bank couldn't care less
Today I found a wallet in the #6 subway station at 23rd St., NYC. Among the variety of cards inside was a BofA debit card. Unable to find the owner via phone or the web, I called Bank of America, figuring they could pass my name and number on to the rightful owner.
1st call to BofA customer service: After three transfers, I was disconnected.
2nd call to BofA customer service: After one transfer, I was disconnected.
3rd call to BofA customer service: The customer service rep took the number down and promptly closed the account. Then she told me she couldn't pass my information on to the card holder. "We're an incoming center only, " she explained.
"How do I get an outgoing center, then?" I asked.
"We don't have outgoing centers, " she answered.
I finally reached the wallet owner through a nearby dance studio, whose card was also in the wallet. The owner, of course, was quite grateful.
As a would-be good samaritan, I was terribly frustrated in my dealings with the bank, which sought only to protect its own interests, not those of the customer.
So a word to the wise: If you lose your wallet and you're a Bank of America customer, odds are good that you'll never see the wallet again, even if an honest citizen wants to return it to you.

My wife and I owned a very successful business called RaveXpress Courier Services. We used Enterprise Commercial Truck Leasing as one of our vehicle suppliers. We got hurt financially with the economy and a bad employee who stole us blind, and so we had to sell our business.
We still owed Enterprise a sum of money for back lease payments, so we set up a payment arrangement. Enterprise got greedy and used my wife's personal debit card to "collect" on the debt owed WITHOUT our authorization! One of the manager's obtained the debit card information from a previous rental car transaction.
We worked with Bank of America to clear up the issue, so they reversed the withdrawals, but then proceeded to take them again two months later after Enterprise supposedly proved they could collect the funds.
We were told by a Bank Account Manager that they would credit the funds again, over $4, 200.00, in two business days. It has been over one month now, and they have only credited half of the above amount. I have spent probably 16+ hours to resolve this issue, and yet it still goes on! I am so angry at B of A right now. Our funds are frozen and we cannot use any of our monies, and have not been able to for over a month. They say that they protect their customers...they are full of themselves and lie so easily. We may have to get a lawyer involved.

The first mistake...on getting it reversed the first time your wife should have had that debit card cancelled. No further transactions could be made using that debit card number. I don't know about the US debit cards, but in Canada, you can't make a debit card transaction without entering your pin number. Enterprise should not have had your wife's PIN number.
At this point, I would open a new bank account and transfer the bulk of funds to that, and don't leave enough in the old account to cover any payments to Enterprise - leave just enough to keep the account open. Once you manage to get the rest refunded to the old account, transfer that and close the old account completely.

Complaint:: My check is direct deposited every two weeks on a Thursday so on Wednesday (day before I get paid) I go around town and pay 3 very large bills with a check and I write 2 small checks for cigarettes, drinks and mail off an additional check. Thursday morning at 12:00am I am monitoring my online BOA account and I have a small overdrawn balance and I update until my direct deposit is received @ 12:05am I have over $1300.00 now I am showing a positive balance and no returned checks I also signed my account up to send me alerts to my cell phones for NSF, direct deposit, and a daily balance. I go shopping Thursday morning after I woke up and dropped my vehicle off to be worked on and got a rental and went shopping and out to eat I pick my car up Thursday afternoon and paid for everything and go home all the bills are paid and I have gone out to eat and shopped and still have money left over I feel good that I have paid bills and got the kids summer shoes and my car is up to date on everything so I'm happy I can relax now. I log into my account first thing when I get home on Thursday and see 5 checks that I had written the day before next to a C for cleared status so I check off in my check book that these checks have been cleared and are paid because the online banking center says the bank paid them and I have plenty of money in my account. Later on Thursday night I log back on to my account to make sure all my debit's have cleared from shopping and vehicle repairs and I see that BOA has credited me back for all 5 checks this is the same day that I have gotten paid I then notice five $35.00 pending fee's conveniently they do not specify NSF (yet) I called the bank and they explained that the checks where presented electronically on the day before (Wednesday) all 5 of them on the day I dropped them off were presented for payments and I asked why they where not posted on the account the day before they said that they are marked NSF when they are presented for payment then they go into review at 12:00 midnight meaning Thursday I asked why they where not posted NSF on my online banking account on Wednesday when they decided to return them and why I did not get my Alerts sent to my cell phone for NSF the supervisor said they are not responsible for not receiving emailed alerts and that the system updates between 12:00am and 6:00am of the next day and I said well why were they marked cleared as if you have paid them and then you credit them back they have nothing to say at all I said if they are in review at 12:00am midnight at the same time my $1300.00 pay check is being direct deposited why did you return them they said they can not refund me the NSF fees because it was not the banks fault that the balance during review at 12:00am-6:00am is more than enough to cover costs that the day after something is posted does not count for the item being presented for payment that the balance for the day before (the day it was presented for payment) is the balance that is effective for the item being returned which is the same thing as moving things around in the system to make the bank more money in fees but instead they make it a "policy" and I told them that I could have prevented another check that I have mailed out from bouncing if I had known that these items we're returned and I was charged $175.00 in fees when all 5 of the checks were returned but it was not posted to my account on Thursday at 12:05am for being returned Wednesday and I did not receive any alerts for NSF and they will not give me my $175.00 in NSF back and I told them to note to the account that I am on my way to the ATM to take out every dollar left before they take the $650.00 left for something that they didn't post the day they decided to pull something out of their ###. I took all this money out so I can go and pay those bills which after $175.00 in fees is not enough and the check I mailed off is not important as Rent, Water, and Electric which is what was returned and then the check I mailed off has now (a day later on Friday) just been posted to my account as cleared and about 30 minutes ago it shows them refunding me the check they took out and is showing a pending $35.00 fee (not specifying NSF conveniently) now I have made a deposit to make my account in the positive by $1.00 and as soon as I pay all the checks they have returned I will close this account I have already called my employer and stopped direct deposit from this bank. I also have a Wood Forest National Bank account (Walmart bank) and they are the best! WoodForest gives you your direct deposit pay check a day early and if they return my check they post it to my account immediately and they post NSF instead of 35 pending fee and then a day later post NSF. Woodforest also does not do credit checks and I have a $400.00 line of credit to over draft now that I have had my account with them for 6 months. I changed my payroll from Woodforest to BOA to get the keep the change where you get money for debit transactions and I have not yet signed up for this service but I will not be signing up for it and I am going back to Woodforest where they refund you 1 NSF or OD Fee a year and they know your face and name and if you OD your account to bad they will put in on a loan for you with no credit check and charge you a small amount monthly until you pay it off so you wont get continuous OD fees and most importantly they admit when they are wrong unlike Bank of America.

We have had a bank of america account for about 3 weeks now, we transferred all of our money to this new account with them. In addition to that had both of our paychecks direct deposit to the account. Quickly we recieve our check card and welcome package. NOW, we never have cash until we get it from the atm and we dont have checks so as I said we transferred every penny we had to this new account since payday was around the corner. We work for two different companiesbut are paid on the same day. We both recieved word that our pay would be into the new account, payday for both of us was 2 days ago and we still have no paychecks, our employers have proff they were sent to B of A, whats worse it that we made 2 other deposit before payday, two for 600.00 each. Means we should have had 1200.00 opening and with our paychecks thats about 3500.00 that should be in my account today. We opened this account online because the small Ky town that we live in doesnt have a good bank so we cant drive to VA everytime we have an issue. So for a week I have been trying to sign into the online banking tells me our account info is not valid. So I call this morning to find there is finally something in the account after 3 weeks but its only 600.00 my husband goes to the ATM to withdraw the entire 600.00 since we have no money at all right now since B of A has it all. He swipes the card and enters the pin number that we chose and it says invalid pin and puts a freeze on the account. After 4 hours of yelling at customer service reps who dont seem to care, we finally talked to a lady who agreed to unfreeze the account but claims it was due to use swiping our debit card too mnay times in another state. Like we could get up drive 5 hours to an ATM and drive another 5 hours back on no cash and doing all this within 2 hours time. They are wrong but she still tells us that we can only use our card for credit purchases and it will be 7 - 10 days till we can withdraw cash because they have to resend us a new pin code. All this and I still cant use online banking and she tells me that she doesnt see any pending deposits either. So somewhere is over 2000.00 of our money . . . I told my husband in 7 days when we get the pin lets go over to the ATM and withdraw everything that should be in the account. The lady tells us that she doesnt know when that it will be on there but B of A can hold the checks on new accounts to make sure that they clear and are good checks. She seems to think that a month is acceptable to wait for a check to clear. I am sure that when we go to the ATM and withdraw 3000.00 that we will have a large overdraft fee and we will probably never know what happened to our money. But we have all the proof that our money was sent to them and when they take us to court we will have the proof of the money and all the times that we contacted them for proof at least we will get our money back. This is crazy I wish that I had read all these complaints before I signed up with them. We were using BBT and I am about to go back they are a great bank we just changed because of the benefits you are suposed to get with the B of A checkings that you didnt get with the other bank. I would trade the benefits for this anyday. Just dont let them do this, scream and kick its your money.

I have had my bank of america credit card for about 10 years. They contiued to up my credit line to $20, 000.00. Now that they are in trouble they have reduced it to $ 7, 500.00. A plain white envelope was sent in the mail and I almost through it out. When I opened it I was surprised to see it was from bank of america. All of the other mailings I receive always have bank of america on the envelope. They are now raising my rate, if I don't contact them. How many people threw away the same letter.
Their customer service is aweful. No one knows who the person is that I last spoke with, "we are too large to know the names of everyone who works here" "oh, that person didn't take notes or put anything about your last conversation." I have been waiting since 3/3/09 to get a problem on my bill corrected. All I hear is "my supervisor will get back to you, no we can't connect you"

pending charges create overdraft fee
I am writing this note to make you aware of the unfair business practices that Bank of America is engaging in.
In the past, banks have charged an overdraft fee for posted items that took your checking account into a negative balance. This practice is fairly standard, and while the fees are high at $35 dollars an item, it is a known charge that each person can avoid with due diligence and careful accounting.
However, Bank of America has taken overdraft fees to a new level. Now Bank of America charges an Overdraft Fee if the "Pending Balance", goes into a negative, even though the actual account balance is still positive. Even though the bank has not yet "PAID" the item. In other words, the pending item has not posted to the account, so the account balance is still positive, but the pending balance is negative, so Bank of America charges a $35 dollar overdraft fee.
My example would be a pending watch repair charge that took my pending balance on Monday, 04/27, to a negative balance, but because of the watch company's merchant services, the item did not post to the account until 04/29. At no time did my actual balance drop below zero, but because my pending balance on Monday, 04/27, dropped below zero, Bank of America charged my account a $35 overdraft fee.
Bank of America changed their overdraft fee policies back in March of 2008, but I never heard of any change. I do not usually run my checking account in a way that this overdraft event would even be a consideration, but this one in a thousand event occurred with the watch repair.
I think the banking system in general and Bank of America in particular should not be preying on the unemployed this way, trying to generate a fee on something that has not even been paid yet. This type of fee generation is wrong, just wrong, and congress should do something about it.

I'm having the same problem with this same bank. Bank of America are crooks, how can they place a $35 fee when they can see that there is money on my account. Somebody has to do something about this injustice.
overdraft charges scam
We signed up for email alerts to inform us when our checking account was approaching 500.00.
Last week we got a snail mail alert (which we've never received before) telling us our account was overdrawn and
that we had accessed 450.00 in overdraft charges. We happen to have a savings account with them that unfortunately,
according to them at least, was not connected to our checking that would have prevented any overdrafting.
I called them today to ask about this and was initially talking to a girl who honestly spoke like a 12yr. old San Fernando Valley girl, it was extremely difficult to understand her, but after about 5 min. of being constantly put on hold while she pulled up my account I was informed that the last email alert they sent us was back in February 09, "well, I understand that, so why didn't you send us one last week"? "I dunno", was basically her response, I am NOT kidding...I asked her before she wasted anymore of my time whether she was in any position to refund these charges and that if not could she please just go ahead and transfer up the next rung to someone who was...she did.
I then spoke to a woman who instructed me that I should connect my savings with my checking to avoid this in the future and that as far as the email alerts go "we have problems in email addresses ending in .net and .com" I AM NOT KIDDING.
I told her, "well that must give you problems with about 90% of your customers I would presume..", "I don't understand what you're saying sir..." Once I got my jaw off the floor I told her that after reading about and hearing reports about B of A
in the news lately I wasn't surprised that she too, obviously was in no real position to approve a refund of these exhorbitant and fraudulent fees would she please connect me with someone who really was, if that someone even existed in her company...she then transfered me to Tony, who after dilly-dallying around with my issues proclaimed that Bank of America does not provide email alerts, (and they are called ALERTS) as a reason for someone to protect themselves from overdraft charges, but are merely a tool they use to "help our customers monitor their account balances".
I'm still reeling about this and am so totally disgusted with this corrupt and vile institution, I plead that our Government explode this unethical institution into a million parts...never to see the light of day again.

Sounds like you need to concentrate more on balancing your account, rather than focusing on the institute bank of america! They are not the people who bounced YOUR checks!

The Credit Union of Texas recently sold their MasterCard business to FIA services. I recently received a letter from FIA stating they were raising my interest rates to 19.99%, a 7% increase. I have an excellent credit score and have been with this credit card since 1983. FIA stated in their letter that, "As part of the Annual Percentage Rate Increase Amendment decision, we obtained consumer report information..." When I called, I was told that they were raising rates for everyone regardless of credit scores. When I asked how that could be they said that the cost of money had risen. When I suggested that the Federal Discount Rate was at 0.5% whereas a year ago it was at 2.50% when it wasn't seen fit to raise the card rate, I was told that I didn't know what I was talking about. I then suggested that they might be trying to cover off on bad loans by maximizing their income on the backs of others. Run away from this draconian company as fast as you can and tell everyone what they're doing. I cancelled my card and will pay it off at the lower rate. What are they thinking?

I am in total agreement. My husband and I had a similar situation where our credit union transferred our cards and management to FIA. We both have had our cards with FIA for 6 years and prior to that 18 years with our credit union. We both received notice that our rate would increase 5% even though we have not had one late payment and we are making double payments. I was also told EVERYBODY's rate was increasing. I was also informed that I could call back in a couple of months to see if the rate would come back down. Doubtful. Seems like those who pay above the scheduled amount and on time are getting penalized for FIA's poor business ethics and customer service. We closed both accounts and obtained a card elsewhere.
I found out they raised my APR to 24.99% without even notifying me about it. When I called them they hang up on me after hearing my complains. I have decided to transfer the balance to my other credit cards and just close this one forever.
Harassment
I have been trying for 4 months to get Bank of America /FIA Card Services to quit sending letters and statements requesting payment on two credit card accounts. These accounts are in my son's name. I have tried to get them to stop the harassment for payment on these accounts. They have been informed since December 2008 that my son was sentenced to prison for 10 years and would not be making payments. Somehow they changed his billing address to my address (I did not call to make this change and neither did my son). The US Post Office was the only place a change of address was made so his mail could come here. I don't know how they got my address. Today, after a Fedx letter was delivered to my address, I called again (4/23/09) to asked that my address be taken off their records. A supervisor kept me on the phone for five minutes trying to threaten what would happen if I or someone else did not make financial arrangements to pay on this account. He kept on with the guilt trip that a parent should take on the financial responsibility of a child (in this case a 45 year old adult). I kept asking him to honor my request to remove my address. I went through much of the same. Hired a Company to represent me. B of A stonewalled them. The returned my money and said I was an my own with B of A as they would not deal with them. After over a year of dealing with B of A they told me I did not qualify for a Loan Modification. Asked for help in making up two late payments was also told NO help was available in fact was told I did not even qualify for a mortgage and that it was only a matter of time before B of A would foreclose on us. This past March I paid over 7k to bring my mortgage current. Kept getting letters from B of A regarding getting a Loan Modification even though I had a letter say from them telling me no. This past October got a late charge on my mortgage payment even though I have not been late. Paid it anyhow. Got two statements for November 1st statement did not show any further late charges. Made November payment on the 5th. On the 6th got a second statement for November this time it show another late charge which would go from $43.84 to over $130.00 if not paid by the 19th. Got all my paperwork that showed late charge already paid and took to local branch of B of A. Bank rep looked at it and agreed on two things. First, did not understand origination of first late charge nor the second late charge. Second late charge was paid. When she went to my account, she had to call a special number? Got the issue resolved with the person she spoke to and said the late charge would still show up on my December payment but to ignore it and just make my regular mortgage payment. Got her signature on document. In 2008 when B of A took over Countrywide I got a late charge which I disputed and was told by a B of A rep that I did not have to pay it In 2009 I had to pay over $627.00 in late charges. This is what started my troubles with the bank. Looks like they are trying to do the same thing again.

I just got off the phone with Fannie Mae today to dicuss the Making Home Affordable modification process that I've been in for over 10 months now with Bank of America. I was told that unfortunately, they are not a regulatory institution and can do nothing about what Bank of America is doing to thousands of people. I was told that Bank of America is the most unscrupulous institution in America, like if I didn't already know this. I was surprised to find out from this gentleman that as of today, this bank has still only approved 4% of all the loan modifications they have received since this process started. This guy even told me that this bank has absolutely no intent on doing anything for thousands of people but to continue to take people's money. They even told me that they are getting calls all the time from people, some telling them after a year or so of making trial period payments to BofA that they were told that Fannie Mae didn't approve their loan, which I was told was a blatant lie, because Fannie Mae said they have nothing to do with it. They did refer me to the FCC and said I should get some assistant with this agency.
I really felt angry after speaking to this guy because if what he is saying is true then I would think they would have contacted FCC themselves and get this fraud straightened out by now. Guess I'll be losing my home and that's okay because at least this insanity will be over, but I won't give up fighting to see that this bank is exposed for what it is and the kind of individuals who are behind all of this.

I CANNOT BEGIN TO TELL YOU HOW I HAVE BEEN TREATED SINCE I BEGAN TRYING TO GET HELP FROM COUNTRY WIDE / BANK OF AMERICA. I WENT THROUGH TRYING TO REFI, MODIFICATION, AND SHORT SALE. ALL OF WHICH THEY SAID TO CALL BACK WHEN THE PLANS WERE IN PLACE. I STARTED IN MAY 2008 I AGGRESSIVELY TO GET A MODIFICATION. I WAS FORTUNATE TO HIRE A COMPANY THAT ACTUALLY WORKED VERY HARD AND GOT NO WHERE. MANY TIMES B OF A SAID THEY CALLED ME AND I NEVER RECEIVED A CALL. BUT MAGICALLY IT IS IN THERE COMPUTER NOTES THAT THEY CALLED AND SINCE I DIDN'T CALL THEM BACK I WAS NEVER NOTIFIED THAT THEY NEEDED MORE PAPERWORK OR PROOF OF SOMETHING. SO TO MY SURPRISE I CALLED IN AND OF COURSE WE ALL KNOW THE ANSWER, MY WORK OUT PLAN WAS CANCELED. NOW IT IS NOVEMBER 2009 AND I AM IN FORECLOSURE AND EACH TIME I START A WORK OUT PLAN AND GIVE THEM EVERYTHING THEY REQUEST, I CALL IN AND I AM TOLD IT WAS CANCELED BECAUSE I DIDN'T PROVIDE SOMETHING. EVERYTIME I CALL IN I CAN NEVER GET MY NEGOTIATOR. I THINK THEY ARE FICTITIOUS. I AM TRYING TO STAY POSITIVE, BUT I AM POSITIVE THAT I HAVE COMPLIED WITH EVERYTHING AND I HAVE BEEN TOLD OVER 5 TIMES NOW THAT I QUALIFY AND TO KEEP A LOOK OUT FOR THE PAPERWORK. BUT I NEVER RECEIVE ANY PAPERWORK OR PHONE CALLS. I CALL IN AND I AM CANCELED. ON TOP OF EVERYTHING IT SEEMS I DEAL WITH CHILDREN AT A REGULAR BASIS. LITERALLY KIDS THAT TALK LIKE THEY LIVE ON THE STREETS. I HAVE BEEN SO STRESSSED THAT I CAN'T SLEEP AND I KNOW I WILL LOSE MY HOME. I BELIEVE THEY ARE NOT IN THE BUSINESS TO HELP ANYONE. THEY ARE ALL CROOKS.
I BELIEVE BAC IS WANTING TO CAUSE PROBLEMS FOR COUNTRYWIDE CUSTOMERS. I HAVE HAD NOTHING BUT PROBLEMS WITH THEM ACCEPTING PAYMENTS. THEY HAVE MY ACCOUNT SCREWED.THEY WAITED TO POST MY PAYMENT UNTIL AFTER MY DUE DATE SO THEY COULD CHARGE ME A LATE FEE. NOW THEY STATE THAT I WAS 3 MONTHS LATE BUT THEY CASHED MY CHECKS. REP STATED THAT THEY WERE IN A SPECIAL ACCOUNT BECAUSE I HAD ASKED FOR LOAN MODIFICATION KNEW NOTHING OF IT. ALWAYS PAYED MY PAYMENTS. NOW THEY HAVE POSTED 2 PAYMENTS BUT CANT FIND THE THIRD. SO NOW I HAVE TO SEND COPIES OF CHECK AND BANK STATEMENT TO PROVE I PAYED THEM. VERY INCONVENT FOR ME TRYING TO PAY. MY ADVICE KEEP ACCOUNT OF EVERYTHING YOU SEND THEM NEVER KNOW WHEN YOU MIGHT NEED A BACKUP. LOOKING FOR ANOTHER LENDER.
