Wells Fargo frozen account

I spoke with Wells Fargo bank on Thursday March 31, 2011. I have direct deposit and to my surprise the bank held my entire pay check. My account online showed my direct deposit as pending, in which, I could not withdrawal any monies. The reason that Loss Prevention stated I was having my account placed on the hold was that I had non-sufficient funds (which of course the bank received their $52.00 for this non-sufficient amount). The bank in loss prevention stated they were closing my account due to the two non-sufficient funds. I am at this point very concerned why I cannot obtain my money.
On April 1, 2011, I noticed the pending action is not on my account and it shows to me that my funds are available, but yet I cannot withdrawal my money. I was not informed by phone or email of any closure on my account prior to my direct deposit only to be shockingly surprised when I go to the bank to obtain $20.00 that my ATM was not working. I have direct deposit so there should be no question as to the bank receiving good funds to cover any necessary fees for non-sufficient funds. I was advised to call again on Monday, April 04, 2011 to see if the bank would release my funds. Yet again, another surprise the bank failed to inform me of is that they are not giving me my money back and that I have a prior account with them that is in debt of $2, 000.00 which comes to a surprise to me as well. I feel the proper way to handle business with them knowing I had a prior account that was due money that the bank would be professional enough to inform me at the time I opened my new account on February 28, 2011 so that way I could make arrangements for this past due amount to be paid on a monthly term instead of going the back door under minded way-- which not only disrupts my personal financial life, but makes me more aware that I will NEVER do business with another financial institution that can control my monies. There still can be a better way to handle this situation then to strip a person from their daily living. This is how I pay my bills and take care of my family in this bad economy. The best way and decent way Wells Fargo could of handled this was to tell me of this outstanding balance when I opened my account on February 28, 2011 and o make arrangements, instead they tip toed around it and took my full pay check without any warning. There must be laws to protect the consumer.

Wells Fargo sudden fees

Wells Fargo lured me to sign up with a business checking account that had no fees. I was going to sign up with a different bank and so the guy at my local branch offered me a special deal. Interestingly he insisted that I must ALSO sign up for a "savings account" with my PMA checking account. It was all free, he said. Well fast forward a year later. Suddenly I see "annual fees" on my statement! I called the 800 number and they would not remove the charges. So I called my local branch and they removed the fees and apologized for the mistake. Now 3 months later I just noticed that they have been billing me $20 a month! I called the 800 number and the SOB in customer care says "I can only reverse charges going back 30 days". How convenient that they pulled a bait and switch and if you don't catch it within 30 days you're screwed! I am having nothing of that and will call the local branch to raise hell again. I'll take them to small claims if I have to. Somebody's gotta stand up to this BS.

The lesson learned is DON'T expect Wells Fargo to adhere to their original agreement and don't expect them to notify you if they change the rules in the middle of the game.

That's right. Lured. I was going to sign up with a different bank that was offering me no fees, so they said they'd match the other bank's no-fee deal. You're obviously not a lawyer -- evidently just an idiot. What matters in a contract is the original agreement -- not what happens afterward. That's called bait and switch.

They just did the same to me. I was told account had no fees as I had a brokerage account with Wells. I had no fees for two months. Then they started applying $30 per month. Charges. If they don't remove them I'm going to close the account.

Wells Fargo extremely slow payment processing

Following the damage assessment of the water damage to our house in Garrison the insurance company paid for it relatively fast.
Unfortunately, Wells Fargo was required to endorse the check from the insurance.
Their processing department "mylossdraft.com" took over and the financial desaster started.
The contractor hired for the repairs/renovations/water mitigation etc. demanded 30% payment of the the costs in advance which is absolutely standard and acceptable. However, no money was paid in advance and the contractor refused to start working. After bitterly complaining about their hard to understand procedure they finally sent a check covering 2/3 of the total insurance payment (23, 679 USD). Even after 80% completion and only by calling them repeatedly for the remaining balance it took another several weeks until the insurance check was fully paid. This procedure is unacceptable and forces innocent people into financial situations which may even lead to bankruptcy and/or foreclosure. I am warning everyone to deal with Wells Fargo very carefully.
Their answers are usually: Our policies, processing time 48 hours, sorry, sorry, sorry

I agree totally! Perhaps other people should do the same. I am talking with my family members, who bank with Wells Fargo, to get them to dump Wells and go with a real banking institution. The Banks are out of control!

I had a fire and Wells Fargo is stringing me along since the insurance company puts the mortgage company name on the check. I get that since they have a lien on the house, however, every time I call I get a different response and a different set of requirements to process the cliam. My garage is being completed today and the bill will be due so I have to pay out of my pocket. I have been trying to get this settled for 2 months and all I get is how sorry they are that they keep screwing up. I actually think their policy is to make the process as difficult as possible for home owners. Trust me as soon as this is settled I am refiancing my mortgage away from Wells, they have lost a customer forever and I am submitting a complaint to my company who happens to use Wells for transfers and relocations and suggest maybe our company should seek someone with better customer service. I would suggest to everyone to drop business with banks and move to credit unions. They are just as safe and way more customer oriented since you are the shareholder.

Nobody gets it. I totally understand what your going thy mother passed away a year ago. I closed her Wells Fargo account, as I had every right to do because I am listed as an authorized user on the account, and yet, they are still sending me monthly statements. I have talked to someone at the bank several times and submitted a death certificate twice to no avail. So, I just don't bother any more. People are supposed to be able to trust their bank with their money aren't they? I am starting to have serious doubts and concerns about the banks in this country as a whole. They are ripping off their customers at an alarming rate, stealing peoples homes through mortgage fraud, lies and deceit, Myself and my wife included. Then they make everything so confusing and when we call them on it they lie about it to every one including the investigating bodies trying to get to the bottom of the problem frustrating everyone to the point of exhaustion. Does anyone else have the same feelings about this?

I have been dealing with getting my money for over a year now. The person that came out and inspected my home was very nice and said that all worked was completed 100%. I have sent the same receipt as of today for the 4th time. They cannot see the bottom where it has been paid in full. Another contractor stamped his receipt paid in full and there scanner cannot read where it was stamped. I take very good care of my home and I don't to be micro managed.

I totally agree. Washington does need to scale back their lack of boundaries! There's too many departments that do not interact with one another. You receive letters of introductions stating their in charge of your account. When you call with a problem which is guaranteed you cannot talk to that person "in charge" of your account. Switch & bait is their tactic ! Yes, bankers, insurance co.s and mortgagors are all in bed with each other !

Why should Wells Fargo even be involved between a Home owner, a contractor and an Insurance Company. I am an adult, have been for many years, I don't need permission for anything. The Banks have given themselves way too much control. Come on Washington! Wake the F@&% up.

It is almost unbelievable what the banks are getting away with now-a-days. My insurance company issued two cks. relatively
soon after damages occurred. Unfortunately checks were issued to myself & Wells Fargo & the hoops you have to jump thru..eeeerrhhh. I do not have the cash flow to pay contractors up front. I have a problem finding a contractor that is willing to not only invest in expensive materials and then be scrutinized to the um-mph degree & willing to wait for their monies after each inspection. I don't blame em, for telling me no thanks! I would too! Trying to make a living is hard enough these days, never mind a G.D. huge corporation trying to run the show. What do they think we are, pathectic lambs that need instructions on everything! Are the insurance companies & banks in bed with each other now? They actually said if there is any money left over, they will keep it & apply it towards my mortgage.? If there is any money left over [not happening ] as the intial adjuster was extremely frugal. In fact I had a few contractors tell me over the phone without seeing the roof damage they told me they didn't need to see damage as sq. ftg. tells em enough that estimate was way to low. I'm straying, the point is if there was monies left over shouldn't it go back to insurance company, how frigging greedy are these corporations now.!

WF sees themselves as above the law and far superior to the Customers (or "Chumps" as they refer to us!).

Going thru the same process with Wells Fargo--Damages/reconstruction costs north of $25K and still finding issues. Our home flooded one month ago-- our insurers were fairly prompt in assessing damage and making payment. When I went to cash the checks yesterday to cover my loss and out of pocket expenses I was informed by Wells Fargo that they were unable to do so until a claim was processed. I was astounded. I've never had my mortgage company involved in an insurance repayment and I have had 6 loans with wells fargo and 5 with other loan companies. After 2.5 hours in the local WF branch and several hours on the phone I now have a 4 page claim pack that I'm supposed to get each contractor to complete and submit through "myloss draft" processors--who surely enough are only open "bankers hours" eastern Standard time...9-7--which doesn't work well for those of us that work for a living 7-7 central.

Interestingly they require proof of US citizenship for each contractor involved in cleanup and reconstruction to allow payment. This in Texas! You can't even ask for that information in the police, security, education public sector or private sector-- however consistent with their heavy handed approach to customer service WF sees themselves as above the law and far superior to the customers (or "Chumps" as they refer to us!).

So far I have been unable to get anyone from "Servpro" fanchisee to "partners in building" head office to agree to the Wells Fargo requirements and waiver of lien...not unsurprising.

Wells wants to have the final authority and final right of inspection to select, supervise, and pay the contractors, but as a result of the "waiver" if there are any problems on the job, the contractors can go after only me-- not WF. Why would any business man limit his options that way? And if he / she did they would have to price that added risk into the cost of services.

Of course none of this requirements around damage claim processing is covered in the loan papers I signed in 2007 and they don't offer any relief on repaying their loan while they impede the reconstruction and repayment process. I will be posting this everywhere there is an opportunity. Perhaps WF will take notice and take a more service oriented approach that actually safeguards their investment and enables the ability of the customer to repay the loan-- rather than the opposite.

I've had to take a loan against my 401K to pay the contractors for work performed and pay my loan on the house I can't return too, while using my salary to pay for living somewhere else.

I paid my bill late. The check hit one day before my money. They said they would re-present the check but couldn't tell me when. After I kept the money in there 1o working days I recalled them and they said just to 'wait" this was on a Thursday Mar 24th. I received a call Saturday March 26th saying the check was re-presented Mar 25th and bounced again...

Wells Fargo fees, concealment, unfair business practices

Wells Fargo sets up their banking and credit account management sytem to profit from not providing adequate, timely disclosures of "fees", use of technicalities, and calculated consumer mistakes (ie caused by them). I inadvertently did on line transfer between my WF credit card, and creditline. 2 days later I noticed a $300 fee for the "cash advance". I immediately called Credit Card Services and explained the circumstances. I spoke to both an agent and a supervisor named "Melissa Miller". Ms. Miller proceeded to tell me she would request a refund if I pay the tranfer back, which I immediately did while on the phone with her. She then said there was no guarantee about my refund of $300, and I did not deserve a refund because technically the transfer was a cash advance and I intentionally made a transfer. I advised that had a notice popped up about a fee (because all other transfers with the other accounts have zero fees), I would have realized the mistake and cancelled the transaction. She was adamant that WF was owed the $300. She gave me contact information for customer correspondence which was a PO Box, and conveniently, no phone or fax number. I believe WF manipulates its system based on a process calculated to cause and profit from mistakes and human propensities. I have had a WF account for 20+ yrs. However due to their practices and abhorrent customer service/grievance procedures, I am going to find another bank and closr my WF credit line and card.

Wow! A refund depends on who you talk to. The first supervisor, "Ms. Miller" was abusive and clearly out to save Wells Fargo undeserved fees, rather than true "customer service". I called back a few days later and spoke to another woman who was very nice. She disclosed that Wells Fargo has accidental transfers happen regularly. Depending on when you transfer the money back, and if you made several purchases in between, they will waive the "cash advance"/transfer fee. In the end, I was given my $300 back!

I just closed my business checking account today. I had been with First Union / Wachovia / Wells Fargo for more than 13 years. There had been a few questionable fees in the past. Recently there were more questionable events and resulting fees which included arbitrary holds on check deposits, early withdrawals for scheduled bill payments, and then unannounced fees for the "free" checking. Good bye Wachovia / Wells Fargo.

Wells Fargo late fee rip-offs and & sunday & due dates

Wells Fargo Financial is a rip-off joint...bunch of heartless, soulless shylocks...Get this, my mail payment for $39 made it through the worst blizzard of the decade in our area, and arrived in the Wells Fargo mailbox 2000 miles away in Dallas on Saturday, March 12, 2011. The payment was due Sunday, March 13. SUNDAY! It sat in their office over the weekend and was posted to acount on Monday morning, March 14th. Wells Fargo immediately assessed me a late fee. When I saw they had done this, I called their customer service rep in Iowa to explain the snowstorm effect, and to question how she could justify denying me a waiver of the fee under the circumstances. She simply said, sorry sir, but we don't give fee waivers under any circumstance. I then spoke with her supervisor, an arrogant SOB who flatly denied any waiver of fee, and then tried to justify how a payment due date could logically be enforced on a SUNDAY! Now I've been a customer of Wells Fargo for 10 years, and had never run into any situation so absurd as this. But after this debacle, I will cancel all my accounts with Wells fargo and NEVER do business with them or through them again.

Wells Fargo credit defense

I just discovered WF Credit Defense has been deducting $129.00 per month for 15 months for this service which i never signed up for. I have written a letter to their dispute dept. after calling the number listed on my account records. this looks like a fraudulent sales call as i have never purchased this type of service and don't need one.

I too have been hit by this group of people. I signed up for a credit card through Wells Fargo, who I have been a long term member. Well. I have noticed that I have been charged 11.95 per month for approximately 5 years now. I have sent Credit Defense a letter, and have talked to my local bank who tell me that I must contact Credit Defense myself as Credit Defense is a third party member not affiliated with the bank. i will call them directly and see if I can get a full refund. I never asked for the service, and do not want it, either.

I got this credit card from Wells Fargo two months ago, and I was encouraged to sign up for the credit defense program. I was told that I would not be charged any fee as long as I pay my balance in full at the end of each month. Well, that was a lie. You are charged $0.89 for every $100 of your balance at the end of the month, whether you pay it in full or not. You only have 30 days to cancel it, and unfortunately I was not fast enough. It looks like Wells Fargo is a bank who tells lies to its customers to steal their money.

Wachovia was much better. I get these credit program calls like every month, asking to sign up for it. Just like a few of you guys, I also was charged for the credit defense program and I nevr signed up for it! They're strting to bug me.

I have had a checking account with Wells Fargo for years with no real complaints. Finally I opened a credit card with them a few months ago...then I noticed this little fee. It was only a little over a dollar last month, and then this month there was another...so I called to get myself out of this Credit Defense program crap (which I honestly do not remember being told I was signing up for it, nor do I remember a fee). Ugh, it was a hassle because the first representative I got on the line kept telling me the benefits and then starts talking about this other Credit Defense that is only .69 cents instead of .89, blah blah blah, even though I was very adament about not needing their program at all...then the call just dropped. I *think* she may have purposely hung up on me, because I was using the landline at work and gee, this line has NEVER dropped any of my calls before, so what are the odds. Fishy. So I called them back, spoke to someone else who actually listened to me, and she said that my profile said the other representative "heard a loud bang and then the phone went dead." Of course the first woman had not taken the program off my account. The second one removed me from the program, or at least that's what she told me...I don't know if I trust them anymore. :-

Wells Fargo did it to me also. I got a credit card with them when I opened an account. I told them I didn't want any extras, but there it was on the first bill. I called customer service and they did nothing. I had to call Credit Defense directly and argue with their representitive. The fee hasn't been removed yet, so I might have to call them back.

Hello,

The same happened to me! I just found out that I was being charged every month for credit card defense even though I said NO when the Wells Fargo's representative asked me if I want it. Overall, I am satisfied with Wells Fargo, but they should consider what their customers' demands are and not sign up customer for the features they do NOT want just to charge money.

I told the representative at Wells Fargo when I got my credit card that I did not want this service and they went ahead and put it on my card anyways. I didn't notice until 6 months later that I had been being charged a few dollars every month. Luckily I was able to call [protected] and get the fee taken off. This service is a complete scam and I am not happy with Wells Fargo for doing this to me when I told them I did not want the service.

Wells Fargo modification etc...

After several phone calls to Wells Fargo to ask to modify my loan, and being told that I was not delinquent therefore they could not assist me with a modification. I finally got someone to listen to me and attempted a modifications in 2008 directly with Wells Fargo just to be told after 3-4 months later that my file sat on the wrong desk in the wrong department. At the time I was not delinquent.
I was given to another individual and was asked to resubmit and told by that individual that I was not delinquent however I was asking for help. She then wouldnt return calls, and when I called in I was informed that they didnt have any paperwork of mine, so if I wanted help I needed to resubmit.
After 8 months passed my income started to take a hit due to the economy and was forced to make the choice to go deliquent and surely I then would get help. This was not an easy choice to make.
After not getting any returned phone calls I took the desperate move and paid a modification company $2500.00 to get me modified, after not successful with this move I then hire yet another modification company, paid them money.
Ive gone through all the soo called forberrance plans just to have my home thrown into a short sale that I did not authorize and found out an wells fargo associate put someone elses shortsale paperwork in my file. Guess what, we had to start all over again.
I could go on on and on with all the mistakes wells fargo had made.
Now after 3 years I decide to shortale, my agent flisted it, a buyer submitted an offer, all was turned into wells fargo, they email the information on the individual who my agent should be intouch with. Keeping in mind my house is still owner occupied. I wount lie I have moved many of my thing out, however we take care of the home and still stay there. After several weeks my agent makes her weekly call and finds out they lost our paperwork, and yes once again we had to start all over. Im just lucky that the agent for the buyer says the buyer loves our home and wishes to hang on with their hopes that someday that can be their home.

After all this, wells fargo changes the locks on my door, as well as puts a lock on my gate. They locked us out. I called wells fargo and told them they locked me out of my home. They appologized and had the company out of Ohio that they hired to change the locks call me and fed ex me the key.
Have you ever heard such a thing? No notice of default, nore was my home posted.
I just hope now everything goes well, this has taken a toll on my children and my marriage. It hasnt been a good experience...

On April 21st and May 9th I posted comments on this site regarding problems with Wells Fargo. Since then I have written a number of letters to Wells Fargo and the Comptroller of the Currency and spoke with several, higher-level people with Wells Fargo. I have the names and addresses of the bank vice presidents if anyone wants to write letters. Wells Fargo's bank president is John G. Stumpf. His work address is: Wells Fargo Corporate Offices, 420 Montgomery St., San Francisco, CA 94104. His home address is 1090 Chestnut Ave., Apt.12, San Francisco, CA [protected].

For Wells Fargo it all comes down to taking your money and not honoring the interest rate that they promised. They refuse to refinance my mortgage that is already with them and they will not give me a refund of the $609 they took from me. Michael Salmon and Michael Dullea received their commisions as well as the title company and appraiser. Believe me, these people are liars and cheats and will wear you down. Wells Fargo does not have to answer to anyone. The Comptroller is a total joke and will just refer you back to the bank to resolve the issues. I am continuing to fight and may have a large number warning posters printed up and put on cars in their parking lot. For me, it's now a matter of principal, not money.

Wells Fargo loan mod

Since I spent two days in NACA in September of 2009 trying to get Wells Fargo to work with us and was told we would be seen and leave with an answer, they came back ten minutes later and told us Wells Fargo was too tired and was going home after two 12 hour days of standing in lines. Then we started to work directly with Wells Fargo to no avail. I even got a number to their Presidential Suite through a connection and was told we would definitely get an answer. Based on the same budget sheet I was told we made too little and too much and the information did not change. Then we hired a Loan Modification Specialist to work on our behalf. They started working with us in April of 2010. Here it is December and we are no further along. Three months in a row they told us they could not further process our loan because they needed to know how many lived in the home and how many cars we had. They used this excuse three months in a row just to hold up our claim. Finally a Fannie Mae just opened in Phoenix and we filled out all their paper work and they have 45 days to get us an answer. Fannie Mae is trying to help people because of all of the complaints. Fannie Mae actually owns the loan and your mortgage company is just the servicer. We have jumped through every hoop they have asked for since September 2009 and we aren't any further ahead. A friend of ours has Wells Fargo and he didn't do anything. He didn't make any payments for 10 months and got a package in the mail from Wells out of nowhere lowering his interest rate to 2% for the life of the loan and rolling in the 10 months he missed into his Principal. Is their discrimination going on? He did not do anything and got an offer directly from Wells Fargo which he signed and it was modified and he was done with it. Fannie Mae assured us we would have an answer no later than 01/23/11. They said it would be before that but give them to that date. Here is is Marvch 20th and we don't have an answer yet. I even blogged this on the Fannie Mae LinkedIn group and Executives from Fannie Mae viewed my LI profile but never called or offerd to help. A gentleman in CA named Angel called and said he would follow up and after a couple of calls he went silent. This whole loan mod thing is a big joke. I read an article that indicated that only one person was helped by the Hamp Funds. It's all show and no go. You can contact me at [protected]@cox.net

Wells Fargo false advertising

I admit it. The ONLY reason I joined something called the Wells Fargo Complete Home Advantage was to receive a free digital video camera. I joined in April 2010 (11 months ago) for a price of $13.99/month. Supposedly, you receive all kinds of bargains when you are buying items for your home and you use this service... There are NO kinds of savings at all. Here it is almost a year later and I still have not received my FREE digital video camera that they promised I would receive in about 6 weeks. After joining last April, I finally did receive a free camera around August...but it was some piece of crap regular digital camera that only takes pictures. Once I received this, I called and told them what happened. I was then told that I needed to wait to receive something from them that states this is really me and mail it back to them (second time that I have done this). I never received this video camera, so I called back again two weeks ago. The "manager" said she will have my monthly fees and send the camera immediately without me filling out another card. Also, I have only been billed a couple of times during the past year from this company which makes me wonder even more. So...here it is a year later and I still have not received my FREE digital camera. I called back again today, and guess what... It still has not been sent! They said I needed to fill out another card that they are sending me. [censored]! Whatever you do, DO NOT affiliate with this company. All they have done is pissed me off and made me several promises in which not one has been kept.

Wells Fargo harrassing, belittling, rude, unhelpful

I have been dealing with Wells Fargo Auto Finance since 2007. My first bad experience started right off the bat, they hit me with a %17.49 interest rate WITH a Co-signer with good credit. I have been paying $400 a month for the past 3 years, I was hospitalized in February of last year and then let go from my job beginning of this past May and I suffered a major financial crisis. I was unable to receive ANY help at all from Wells Fargo. I had to ask friends and family to help me so I would not lose my car and in turn run the risk of not being able to commute to and from my new job. I kept up on payments, some were a few days late and of course they charged me late fees and tons of finance charges. I was told this past December that I was behind by one payment for Novemeber and I needed to pay at least $400 to catch me up by December 21st and then they would defer the December payment to help me out. I paid the $400 and the deferral never happened. I then began working at a new job and I explained to them that I would be able to make a payment once I get my first paycheck and pay rent... I received approximately 10 calls a day starting at 8am and continuing until 9pm. I had one representative in particular, James, who was INCREDIBLY rude and degrading. I tried speaking with him on about 4 different occasions, every phone call I made seemed pointless. I would end up in tears because he was so rude to me... I have been begging for help since last year and all they do is threaten to repo my car if I don't make a payment right then. The reason I am writing this today is because I have been skrewed once again... After being hung up on by James on numerous occasions, I FINALLY got a hold of his supervisor... She wasn't much nicer but I felt I had actually gotten somewhere with her... She told me "You owe for 3 payments. You were behind December and January and your February payment is due. If you don't make this payment by the 20th of this month, the car will be repossessed. Since the 20th is actually a holiday, I have to set it for the 18th" ... I agreed to set up an EFT for $1178.00 to get me completely caught up... Well, I received another bill in the mail and guess what... Now I am supposedly one month behind again. So, I call today... Get another RUDE representative on the phone and she is completely unhelpful and she just transferred my call over to James... What does he do? He tells me that I am mistaken, I don't know whats going on, his supervisor never told me that I would be caught up, I'm not telling the truth... I asked him for his supervisors number so I could call and ask her directly what was going on... he rambled off the extension number and I asked him for the phone number I should use... He asked "What, you don't know the number here?" and I told him I wasn't sure which one to use and he said that that was too bad, told me to have a nice day and hung up on me. This is the worst customer service I have ever experienced and I hope something gets done about it.

The phone # I was told to call was [protected]. I looked it up in the reverse pages, and it came from Bellevue Wa. It was the same as all of the stories above. Thick accent, threating arrests. I hung up, and the jerk called back, and has been calling evry morning since. This was not through Cash Net, so there must be many of them out there. Contact FTC.gov

Wells Fargo scam contract

Here is the short version of what happened:

I opened a small business with my business partner and we were starting from scratch (neither of us had a large amount of money). I had been banking with Wachovia for years and had no complaints. After a few months our Wachovia account was transferred to Wells Fargo and this is where the problems began...

We opened up out business account and I was immediately approached by Dodie Schmitt the Merchant Service rep about a mobile merchant processing account. She verbally told me the equipment would be much better than the rates of our current online service (paypal @ 2.7% +$.30/transaction) and she handed me a bunch of paperwork and circled some numbers saying she was waiving all of the set-up fees and our new rate would be 1.7% +$.2/transaction. This sounded great and I briefly looked over the contract and signed - worst decision ever.

After a week I received the mobile merchant equipment in the mail with a billing statement that was clear as day that Wells Fargo would charge $55 per month for the service and the merchant equipment leasing company would charge $45 per month plus to transaction fees per transaction. I was outraged and immediately pulled out my contract. After combing through I found in the fine print a box with the following information " Lease 48, $38." When I signed I was told the $38 was the set-up fee and there was absolutely no indication that, "lease 48" meant 48 MONTHS with a monthly charge of $38. I was outraged and immediately tried contacting Dodie Schmitt to get out of the lease, return the equipment and cancel the service. After several failed phone calls and e-mails she reffered me to her superior where I repeated the process of failed phone calls and e-mails.

All of this was over 5 months ago. I have finally found that in order to cancel the service through Wells Fargo I must pay a $500 early termination fee and in order to cancel the equipment I must pay out the remainder of the lease, which totals to $1, 830. This is over $2, 300 in charges for a piece of equipment that has NOT been used and I have already paid over $500 to sit in a box in my closet.

We are a small business trying to get off the ground and I feel punished and abused by Wells Fargo. I have always known to read the details and fine print before signing everything but the contract I signed with Wells was deceptive and very unclear.

Does anyone have any tips, hints or comments on how I should pursue this further?

You have a couple of options.
1-you can find another processor and pay your monthly minimums to Wells Farg until the end---they cannot force you to process with them
2-depending on how much time left on your lease we may be able to help you out of it

Wells Fargo fraud

ABout 2 yrs ago I got behind on a few mortgage payment, Wells Fargo told me they would work on a Loan Modification for me, i thought that was nice of them so I summited all the paper work they asked from me. But everytime I called there was something wrong: we didn't receive it, fax it again with a updated date, so it went on like that for months, they called me in early November telling me that my house was in Foreclosure and that i needed to send $1851.00 by the 9th I called my mother and she wired me the money, as soon as I got it I sent it to them with a quick collect through Western Union. I called them they had received the money but for some reason they had to send it back and it had to be there again in three days! by this time am lost, They have the money some where on hold then they will cut me a check mail it to me then I have to send it again? I told the lady there was no way I was going to get that money and send it back with in three days it didn't even make sense, So Mayra Gomez called me dce 22, She told me that i had til March 4 to bring my account current, The Bank Had told me to keep sending them the money through western union so i send them 640.00 on Jan 2011 called the bank to see how much was the delinquined amount they told me to call thier lawyer at that time I told the bank rep that I had $3500 to send again they told me to send it to them through western union and to call their lawyer and ask them for the reinstatment amount, ..I called the lawyer's office and spoke to Silvia who said she had requested the reintatment quate but she got mad once i told her the bank was taking the money she said if the bank is taking the money let them tell you the reinstatment amount, , I later found out she had cancelled my request, she told me that the bank had requested the reinstatement quote Jan 22 and they should be able to give it to me, that was the answer I got from both office noone was willing to give me that information and the weeks were going by called once again to see if anyone would give me that amount and noone did, so i did what I thought was right I send $4500.00 to the bank again thinking that was enough since they told me back in Dec 2010 that my delinquined amount $3200 so thinking $5200.00 was going to cover it...boy was i wrong my house was sold on March the 1 not the 4 bank says i got that wrong, so now my house been sold i still dont have nothing in writing letting me know all the charges but i did get an amount for Silvia on MArch 3 my delinquin amount close to $7000...how did that happen who know, and now she can give me that amount after I had been calling for months for that 2 days after my house was sold I get an answer, I been talking to the bank about my case they said they are working on a resind foreclosure to see what they can do there is no guarantees on us keeping the house, I just dont understand how they got the money and still took my house, i have cried all the tears i had for this mess they have done with me and all those other families out there too, what is happening? how come the goverment doesnt stop these ###. It's all about money to them, no one cares what happens to the victims.

I bought a house in 2005, and my loan was assigned to Wells Fargo. A few months into our loan our payment went from 950 a month to 1350 due to an increase in taxes on our property. We made the payments but struggled and lived like peasants. We contacted Wells Fargo and tried to do a loan modification in 2006, and Wells dragged their feet about the whole process, and finally decided in Sept of 2006 that we would not qualify for a loan modification. So we contacted people to do a short sale because that is all wells was willing to do. We found a buyer and we started a short sale(which should be called a prolonged sale), we scrapped to make the payments until wells started the paperwork. Wells decided late in 2006 that it would not continue with the sale and decided to go ahead with a foreclosure. The buyer was a lawyer and told wells to honor its arrangement or face a lawsuit so wells gave in. We thought we won. Wrong.
Wells Fargo dragged their feet about the whole process, transferring our case from one person to another, failed to provide correct documents pertaining to our loan and, even tried to change the price of the property four times as the market crashed in 2007. We finally were closing at the end of April, then pushed to May and when it was all over with I was provided with a pack of paperwork with 3 different sets of dates on it. I thought I was done with until I received a letter from the Register of Deeds about a house I owned. I contacted them and found out that wells fargo never filed the closing paperwork with them. I sent them a copies of the paperwork and by law wells fargo received a fine for not filing the paperwork within a time frame.
Now its a few years later and we are trying to buy a house and wells fargo is still sticking it to us. They reported we were more than 120 days late on my credit even after our closing, they failed to pay the government for my FHA backed loan on time and only paid after they received notice from HUD. I was told today by HUD that I would be lucky to buy a house FHA next year and I would be better off saving my money and buying cash, because of the information Wells Fargo provided HUD/FHA about our loan.

Hi:

I went to Wellsfargo for re-finance, application fee is zero but they were rushing me for appraisal. I locked my rates for 60 days and didn't hear for a at least 6 weeks. So I called and requested that processor called me back. 2 weeks went by no one called. I called their mortgage 800 number and asked for manager or anyone who can help me. By the end of the day the processor called and again nothing much happened. after couple of days went by again and my person who took my application called back and said oh you didn't sign some papers. Actually I did but then no point of arguing so I said please send me the papers and I will sign and send you back. She sent me papers and papers were wrong. They included my tax and I said this is wrong. I always paid them separately.

So, I never received correct papers and 60 days expired so now they are telling me that if I want my rates to float, I have to pay +/_ $1900 or if I want to extend the locked rated, I have to pay them $ 495. So I paid for appraisal, didn't get to close, reapplied again and now don't know when will they close.

We tried to do a loan modification through Wells Fargo a few months back. The first two people that I talked to about the application process and what was expected of us while waiting on approval informed me that my payments would be put on a hold status. The second person actually told me that if I even try to make a partial payment that I would be denied for loan mod because they would consider us able to keep up with our payments. Well a few weeks later my wife got a call from one of their ###s telling my wife that if we don't make our 2-3 months back payment within so many days, they will foreclose on our home. My wife is about 5-6 months pregnant at this time and is already emotional without some idiot telling her we're going to lose our home. She called me crying and hysterical. So I called WF(wells fargo), already fired up. I explained to the she-### what the first two idiots told me and you know what that &*#^! said? I'm sorry sir but you were misinformed... Instead of saying well we'll look over our records and get back to you and work something out, she says, "I'm sorry sir, there's nothing we can do. You were misinformed." I about lost it. I couldn't believe what I was hearing. Is this kind of crap really allowed to happen? She tells me I can fax a letter to "written Correspondence" and explain my complaint and maybe they can do something about it. She said they would get back to me in 7-14 days. In the meantime I had to set up a repayment plan so we don't lose our home. Get this, we apply for the loan mod because we couldn't afford the $684/month at the moment due to my life losing her job and me being laid off. The only repayment plan they would set up for me was i pay $346.99 on the 1st of December. Then on the last day of December, January and February we make payments of $1036.28/month. Then we make a $775.07 payment on March 31st and THEN on April 1st we pay our normal $684 unless they try raising our normal payment AGAIN. How does that work when we were already having trouble making the normal payment. In the meantime, I decided to call today to check up on our complaint that I faxed in. It was also a request to hear the recorded conversations and I was hoping that once they confirmed what the first to people told me, maybe they would work something else out with our payments. Instead the lady told me that my letter was filed but other than that it did me no good. And if I wanted to hear the recordings or get any record of the I would have to have a subpoena. I asked to speak to a supervisor and explained things to him. He said he couldn't help me and transferred me to Loss Mitigation and I waited on hold for another 10 min and WF terminated my call. I am ready to join this Class Action Lawsuit. Please let me know if anything gets going on this or if anyone has any advice. Because if WF gets their way, they'll be taking our home away just in time for our baby girl to have no home to go to when she's born in February. DOWN WITH WELLS FARGO!

Wells Fargo not returning a client's money

You would think that a large financial institution such as Wells Fargo bank should have their business under control. Yet again, Wells Fargo’s Business Direct, which is Wells Fargo Business Credit Card Department that reportedly employs forty bankers, screwed up.

I first opened a Wells Fargo business credit card account for my new business back in 2006. It was a brand new enterprise, and thus I was offered a secured credit card. The credit card limit would limited by the amount of the collateral that I was required to put in the bank in order to have said secured credit card. I applied for a secured credit card with the credit limit of one thousand dollars, which was secured by opening a separate savings account at Wells Fargo as collateral and by depositing one thousand dollars into said collateral account.

In the beginning of 2007 I decided that I no longer needed said secured credit card and I went to a local Wells Fargo branch to request closure of the credit card account. The trip to the branch was useless, as branch personal advised that because the credit card was in fact a secured credit card that required return of the collateral, the only way to close the credit card account and to get the collateral refunded was to call a toll-free number on the back of the card.

Upon returning home, I called the number on the back of my credit card. The Wells Fargo rep that I spoke with said that for some strange reason she could not close the credit card account over the phone and that in order to close my credit account she needed to send me some paperwork for me to sing. She said the paperwork would be arriving in the mail within a few days. At that time the card was already paid off.

I waited and waited. No papers from Wells Fargo ever appeared in the mail. I went to a retail branch again. Needless to say, that trip was as useless as the first one was. Once again, I was advised to call the number on the back of the credit card.

I called. The rep on the phone put me on hold for a long time. When he returned, I was told I would be transferred to someone else. That someone else was in fact the first person who was somewhat helpful. The first thing that he said to me was “I don’t understand why they couldn’t do it at a branch.” Well, that was a relief! After apologizing profusely, that someone else assured me that the credit card was now closed. However, while I was waiting for the promised paperwork since the first time I called to have the account closed, I incurred an annual fee in the amount of $25, which was now bringing my credit card balance to $25!

However, the rep explained that he was going to take care of the annual fee by reversing it, which would make my account balance zero. He said, however, that would take some time and that while the fee was refunded, the credit card account could not be closed. He assured me though, that once the annual fee was reversed, the credit card account would be closed.
Later on I received a letter stating that my credit card account was closed. Yet, no refund of collateral was issued. With the letter that I received from the credit card department I went to a local branch. Local branch personnel was not helpful (as always) until I insisted that they make the necessary phone calls. I expressed in a polite manner how frustrating it has been doing business with Wells Fargo and how long it took to do a simple things such as closing a credit card account.

Branch personnel made a phone call to the appropriate department. The person on the phone said that for collateral account it takes up to thirty days to issue a refund check. I was assured that I would be receiving a check within thirty days, but no later them thirty days since the day the credit card account was officially closed.

Thirty days went by. Still no check. Another ten days went by. I went to the same Wells Fargo branch again. A personal banker that I spoke with said that she had no access to see what went on with my credit card account, since the account was closed. Again, she advised that I call the number on the back of the credit card.

When I told her the whole story and how painful it had been to deal with Wells Fargo regarding this issue, she started pointing at her computer screen frantically repeating over and over that she had no access to said credit card account.

“Look, ” I said, “I don’t care how you handle that. Wells Fargo owes me money. If I don’t get resolution of this problem today, the next call your bank will be receiving with regard to this matter will be from my attorney.”

“I can call the business credit card department, ” she said.

“Please, ” I said.

The banker dialed a number on the phone and after speaking with someone she was transferred to another department. Finally it was the department that handles business credit cards. The banker explained the situation. After hearing what the Business Direct rep on the phone replied to her, the banker offered the telephone to me.

What I heard was beyond audacity. Business Direct representative told me that my card was NOT a secured credit card.

“Excuse me?” I said. “Are you saying that there was never a collateral to the account?”

“No, ” she said, “it wasn’t a secured credit card.”

“But how could that be?” I exclaimed.

“There wasn’t a collateral, ” she repeated. “I don’t show any note on the account that it was secured.”

“But I know it was!” I exclaimed. “I gave Wells Fargo a thousand dollars to have this secured credit card open for me!”

“Well, ” she stammered, “if there was a collateral, it must have been taken to cover the unpaid balance on the card.”

“But there was no balance, ” I said, “I paid the card off long before it was closed and I did not charge anything else on it.”

Now when I think of it, it was even stranger since even if Wells Fargo tried to pull this on me and take some money for what they claim the unpaid balance was, there was no way that the alleged unpaid balance would be exactly the same as the credit card limit.

Wrapping up my conversation with the Business Direct representative, I asked if she had any idea of how we could proceed toward the resolution of this problem.

“I will look into that and have the department investigate the reasons why your collateral was not returned. Give us a call at this number sometime tomorrow and we’ll tell you why you did not receive a refund. If there was an error on our part, we’ll let you know; or we’ll let you know why you are not getting any money back.”

To summarize, I first attempted to close this credit card account in March 2008. It has been four months since, and it doesn’t look like I am ever going to get my money back. It is interesting to me and I am very curious, how in the world does Wells Fargo do its accounting. If money comes from somewhere, it should go somewhere. The collateral account was on my name and I wonder what kind of creative accounting one should do to have a thousand dollars magically disappear? Imagine this; you take a thousand dollars and put it into a bank account. When you come back to draw your thousand dollars from your bank account, the thousand dollars is gone. I wonder if self-proclaimed “accounting professionals” such as this financial institution in fact ever studies accounting.

My account graduated and they even increased my limit to 1300 dollars.
But they are not returning my $700 collateral and its 3 months now... Wtf.

Did you ever receive your refund? I am having the same problem except with $300.00 collateral deposit. I am constantly told my check was mailed and I will have to complete a stop payment affidavit. However, nothing ever comes in the mail. I receive OTHER letters from Wells Fargo but not my refund check or stop payment affidavit that I request almost EVERYDAY. Its been a frustrating 4 months. I only want my $300 to pay off my account.

Wells Fargo refusal to honor my wells fargo check

On 3/8/11, we wrote a check from our Wells Fargo Preferred Rate Savings account to transfer money ($20, 000) to our Wells Fargo Crown Classic Checking account. We deposited the Preferred Rate check via the drive through window and received a deposit slip. We proceeded to pay some sizeable bills via the checking account. On 3/12, we received notice that Wells Fargo was not honoring the Preferred Rate check due to "signature irregularities." We immediately went to the bank to meet with a banker to straighten out the problem. The banker Laura Reynolds was very irritated with us for challenging the legitimacy of not allowing us to transfer from our account a to our account b. She got more and more irate, informed us that we would be paying a $12 returned check fee and would be responsible for any bad checks. When I challenged this, not in a raised voice, she threatened to call the police, close my accounts and take "further" actions. This woman should not be a personal banker and Wells Fargo should have to explain how transferring money from one account to another account in the same name is possible fraud! We should not be responsible for any fees and Wells Fargo should have to contact American Express where the check was returned for insufficient to explain their error. I do not have the copies of any checks to attach.

I agree, a terrible bank, I could not get my money out of there fast enough. When I opened my account, the guy freaked out when I turned down direct deposit, he just kept hassling me to sign up for direct deposit. I told him I worked on call for a school disdrict, and my paychecks were sometimes many weeks apart, I would come into the bank to deposit a check, he just kept hasseling me and put me on the defensive, for the crime of wanting to deposit my paycheck in person !

Wells Fargo predatory actions

ATTN: Predatory Mortgage Actions

To Whom it may concern;

Due to an EMC Mortgage Company clerical mistake, I’ve had to go to court every month from August 2009 thru February 2010, to stop them from selling my house via Sheriff Sale.

This started in May 2009. I sent in my normal payment of 732.00 on the 10th of May, EMC receipted it on May 11, 2009. I then received a letter dated May 14th, 2009, stating that “…..we have not received your 03/15/09 forbearance payment(s) in the amount of 732.00…..”

I called to clear up matters and was met with such insolence from Ruben, Emp. ID: REU, that I sent a fax to his Supervisor: Erica Reeder via two different fax numbers: [protected] & 1297. I did not receive a reply from anyone.

By the following Saturday, a very bold notice of Sheriff Sale was taped to my front door.

I faxed copies of 12 consecutive receipts of payment, including May 10th 2009, to EMC Mortgage and their representing lawyers: Gregory Jarvardian, yet, I did not receive a reply from anyone. EMC also mailed a payment history for Account [protected], which also showed a receipt of payment on 05-12-09. Both items prove that I have not forfeited on my obligation to pay the agreed upon mortgage fee.

Since no one was listening or responding to my questions, proof of facts or giving me any other type of communication, I was forced to file for a Conciliation Conference. In the interim, I continued to pay the monthly mortgage fee.

And each month it was returned to me, which gave me the impression that EMC was trying to force a foreclosure.

At the first court appearance, the lawyers representing EMC seemed taken aback when I showed them the stack of payment receipts, proving that an obvious mistake had been made and that there had been no default of the forbearance agreement. But it turns out that the receipts have not canceled the foreclosure, they have only generated postponements of the foreclosure: 09/01/09, 10/06/09, 11/03/09, etc., until we came to February’s conclusion.

The conclusion being that EMC re-modified my original loan agreement to the following:
The Unpaid Principal Balance of your Loan will be adjusted as follows:

Current Unpaid Principal Balance $50, 739.81
Interest $ 7, 632.11
Escrow Advance 1 $ 443.15
Recoverable Balance, Foreclosure/Bankruptcy Costs (If applicable:) $ 8, 807.40
Adjusted Unpaid Principal Balance $67, 622.47

1 Funds that EMC has advanced on your behalf to pay taxes and/or Insurance premiums or other escrow Items.
2 These are servicing expenses and/or fees (such as NSF fees) that have been assessed to your account.
• The 'new principal and interest payment will be $367.14, plus escrow funds of $183.35, which equals a new total monthly payment amount of $550.49. Please note this amount is subject to change if there is an increase or decrease in your taxes or insurance premiums or other escrow items.
• Your new due date, upon returning this signed Agreement, will be March 1, 2010

(There is also an 'End of Mortgage' Balloon Payment of $14, 000.00)

The sale price for the house was 65, 000.00 when I bought it in 1992. My family and I have lived in this house for 17 years. Yet, this is the result of their re-modification of a 30yr minus 17yr mortgage. Missing from the calculations is the fact that EMC failed to note that they have not paid on the Taxes for the house in over a year. And if that wasn’t bad enough, weeks later they sent a notice stating that I have to pay the added amount of 209.06 for Escrow + amounts, making the monthly mortgage amount 763.19. For the last 3-4 years the mortgage amount was 732.00, with no missed payments. Prior to that, it had been 932.00 a month.

I need to mention that I am on SS-Disability: 1168.00 monthly.

It appears that they created this situation for the purpose of taking away my home and at this point they are doing their best to make it difficult for me to maintain my home.

Some of their actions seem very predatory and they are not following the guidelines of the “Obama Plan”.

Can your office provide me with some assistance in this matter?

These people are criminals. So far I guess the FTC is ignoring people's complaints about them, because they are continuing in the same direction without regard. Somebody will need to give them a wake up call, the least expensive way possible...

Wells Fargo hassassing phone calls

Wells fargo has been computer harassing my friend repeatedly every 1- 2 hours everyday! home than work than cell phone. He talked to a real person that he was having some problems..this is his first time being late...but the calls keep coming starting early in the morning...ALL DAY LONG!...He hates them and we are looking for another band etc...Who should I report this harassment to?Wachovia is in big trouble if this is how they treat people..Shame on you Wells Fargo..there is nothing WELL about you, , , and you have FAR to GO knowing how to treat people!

Wells Fargo hardship

With the American economy currently facing a 9.2% unemployment rate you would think the company who identifies itself as an American company and proudly displays images of a stage coach at every branch would be more than happy to help the Americans who for years have bought into the various services and banking products offered by Wells Fargo but who are struggling to make ends meet in today’s tough economy. I have a car loan with Wells Fargo in 2009, I cosigned for my little brother who didn't have enough established credit to qualify on his own and he was to make the payments every month. He paid on time every month for over a year until he lost his job this past January. At that point I picked up the payments and have been making them late ever since because I simply did not have room in my budget for an extra car payment. I have pared down my budget considerably to try to maintain the payments but the payment is simply getting harder and harder to make. I turned to my car company in hopes on getting a payment differed to help me to stay afloat. The agent I initially spoke with was rude and unsympathetic to my situation in fact she made the comment and I quote "Maybe I'm not understanding but I do not see what your hardship is” at that point I asked to speak with a supervisor. The supervisor I spoke to had the nerve to tell me and again I quote "unemployment is not a hardship but once he is back to work call us back and we should be able to help you". I was completely blown away that a company that boasts being American owned and operated could be so unsympathetic to the hardships facing its American customers. I also have a car payment with American Honda Finance and when I called for help with my payment this non American company was more than happy to help!

Wells fargo Dealer Services is Horrible. I was in the process of a hardship refinance. At the start of the process I was told I had to make a total of 12 payments and wait until my current payment was 5 days past due and the hardship loan would be guaranteed as long as i met hardship criteria(which I did). During this time I was told not to make the current loan payments as i would be getting a new loan with new terms. In that time I as given much conflicting information and eventually given a monthly payment total. I was told that final signature was being obtained thatn I would receive the packet in the mail. I decided to do another follow up call since the people there promised to call but never did unless they were calling about pmt on the existing loan. Long story short, after 2 months I was told my "guaranteed loan" was denied. I am currently contacting legislatures and their corporate and divisional managers. they must be held accountable for poor customer sevice and lying to people who are trying to do the right thing in these difficult times

This email was in my inbox this morning. For those who may not know, Wells Fargo Bank is a very large bank in the Western part of the United States, but they are expanding across the country. I do not bank with Wells Fargo, yet the scam artists who created it don't know that.
The scam works like this, the potential victim receives an email stating their online banking is blocked, and needs to be resolved. The victim is then redirected via a link provided in the email to a "fake Wells Fargo site" (this is called "phishing" in the cyber world of crime), where they are instructed to enter an online ID and password.
Once this information has been entered, the scam artists now have your personal online banking information, if you are a Wells Fargo customer.
The following is the letter I received:

Because of unusual number of invalid login attempts on you account, we had to believe that, their might be some security problem on you account.
So we have decided to put an extra verification process to ensure your identity and your account security.
